An Act to Amend the
Edmundston Act, 1998
Assented to March 16, 2018
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:

Section 1 of the Edmundston Act, 1998, chapter E-1.111 of the Acts of New Brunswick, 1998, is amended
(
a
)
in subsection (1) by repealing the definition “quorum”;
(
b
)
in subsection (2) by striking out “created” and substituting
“continued”
;
(
c
)
by repealing subsection (3).

Section 2 of the Act is repealed and the following is substituted:

(1)
The city called Edmundston is continued.

(2)
The parcel of land identified as NB PID #35349224, being an area contiguous to Edmundston, is annexed to Edmundston and the new territorial limits of Edmundston are shown on the plan attached as Schedule A.

(3)
The effective date of the annexation is January 1, 2019.

(4)
The inhabitants of the area referred to in subsection (2) continue as Edmundston.

The heading “FIRST COUNCIL” following section 4 of the Act is repealed.

The heading “Application of the Municipal Elections Act” preceding section 5 of the Act is repealed.

Section 5 of the Act is repealed.

The heading “Residency” preceding section 6 of the Act is repealed.

Section 6 of the Act is repealed.

The heading “Eligibility of officer or employee” preceding section 7 of the Act is repealed.

Section 7 of the Act is repealed.

The heading “Eligibility of member of council” preceding section 8 of the Act is repealed.

Section 8 of the Act is repealed.

The heading “First election” preceding section 9 of the Act is repealed.

Section 9 of the Act is repealed.

The heading “Wards” preceding section 10 of the Act is repealed.

Paragraph 21(b) of the Act is repealed and the following is substituted:

)
secondly, be applied towards any outstanding debt of Edmundston.

The heading “Composition of council” preceding section 30 of the Act is repealed.

The heading “Division of municipality into wards” preceding section 31 of the Act is repealed.

Section 31 of the Act is repealed.

The heading “Taxation zones” preceding section 32 of the Act is repealed.

The heading “Continuance of borrowing authority” preceding section 33 of the Act is repealed.

CONSEQUENTIAL AMENDMENTS
AND COMMENCEMENT
Regulation under the
Education Act

Paragraph 4(b) of New Brunswick Regulation 2001-24 under the Education Act is amended by striking out “created” and substituting
“continued”
.
Electricity Act
48
Paragraph 88(2)(a) of the Electricity Act, chapter 7 of the Acts of New Brunswick, 2013, is repealed and the following is substituted:
(
a
)
the territorial limits shown on the plan attached as Schedule A of the
Edmundston Act, 1998
, as that plan existed on the commencement of this paragraph, and
Real Property Tax Act

Section 5.01 of the Real Property Tax Act, chapter R-2 of the Revised Statutes, 1973, is amended
(
a
)
in subsection (1) in the definition “rate” by striking out “the tax rates referred to in paragraph 32(4)(c) of the Edmundston Act, 1998,”;
(
b
)
by repealing paragraph (3)(c);
(
c
)
by repealing paragraph (5)(b).
Regulation under the
Regional Health Authorities Act

Paragraph 6(2)(b) of New Brunswick Regulation 2012-7 under the Regional Health Authorities Act is amended by striking out “created” and substituting
“continued”
.
Commencement
51
This Act comes into force on January 1, 2019.
