An Act to Amend the
Edmundston Act, 1998
Assented to March 16, 2018
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1Section 1 of the Edmundston Act, 1998, chapter E-1.111 of the Acts of New Brunswick, 1998, is amended
(a) in subsection (1) by repealing the definition “quorum”;
(b) in subsection (2) by striking out “created” and substituting “continued”;
(c) by repealing subsection (3).
2Section 2 of the Act is repealed and the following is substituted:
2(1)The city called Edmundston is continued.
2(2)The parcel of land identified as NB PID #35349224, being an area contiguous to Edmundston, is annexed to Edmundston and the new territorial limits of Edmundston are shown on the plan attached as Schedule A.
2(3)The effective date of the annexation is January 1, 2019.
2(4)The inhabitants of the area referred to in subsection (2) continue as Edmundston.
3The heading “FIRST COUNCIL” following section 4 of the Act is repealed.
4The heading “Application of the Municipal Elections Act” preceding section 5 of the Act is repealed.
5Section 5 of the Act is repealed.
6The heading “Residency” preceding section 6 of the Act is repealed.
7Section 6 of the Act is repealed.
8The heading “Eligibility of officer or employee” preceding section 7 of the Act is repealed.
9Section 7 of the Act is repealed.
10The heading “Eligibility of member of council” preceding section 8 of the Act is repealed.
11Section 8 of the Act is repealed.
12The heading “First election” preceding section 9 of the Act is repealed.
13Section 9 of the Act is repealed.
14The heading “Wards” preceding section 10 of the Act is repealed.
15Section 10 of the Act is repealed.
16The heading “Voting by wards” preceding section 11 of the Act is repealed.
17Section 11 of the Act is repealed.
18The heading “Powers of council of affected municipality” preceding section 12 of the Act is repealed.
19Section 12 of the Act is repealed.
20The heading “Powers of first council of Edmundston” preceding section 13 of the Act is repealed.
21Section 13 of the Act is repealed.
22The heading “Remuneration of members of first council” preceding section 14 of the Act is repealed.
23Section 14 of the Act is repealed.
24The heading “Provision of information” preceding section 15 of the Act is repealed.
25Section 15 of the Act is repealed.
26The heading “Powers respecting orderly transition” preceding section 16 of the Act is repealed.
27Section 16 of the Act is repealed.
28The heading “Acceptance of office” preceding section 17 of the Act is repealed.
29Section 17 of the Act is repealed.
30The heading “Conflict of interest” preceding section 18 of the Act is repealed.
31Section 18 of the Act is repealed.
32The heading “Second election” preceding section 19 of the Act is repealed.
33Section 19 of the Act is repealed.
34Paragraph 21(b) of the Act is repealed and the following is substituted:
(b) secondly, be applied towards any outstanding debt of Edmundston.
35The heading “Composition of council” preceding section 30 of the Act is repealed.
36Section 30 of the Act is repealed.
37The heading “Division of municipality into wards” preceding section 31 of the Act is repealed.
38Section 31 of the Act is repealed.
39The heading “Taxation zones” preceding section 32 of the Act is repealed.
40Section 32 of the Act is repealed.
41The heading “Continuance of borrowing authority” preceding section 33 of the Act is repealed.
42Section 33 of the Act is repealed.
43The heading “Pensions” preceding section 34 of the Act is repealed.
44Section 34 of the Act is repealed.
45The heading “Payment and services” preceding section 35 of the Act is repealed.
46Section 35 of the Act is repealed.
CONSEQUENTIAL AMENDMENTS
AND COMMENCEMENT
Regulation under the Education Act
47Paragraph 4(b) of New Brunswick Regulation 2001-24 under the Education Act is amended by striking out “created” and substituting “continued”.
Electricity Act
48Paragraph 88(2)(a) of the Electricity Act, chapter 7 of the Acts of New Brunswick, 2013, is repealed and the following is substituted:
(a) the territorial limits shown on the plan attached as Schedule A of the Edmundston Act, 1998, as that plan existed on the commencement of this paragraph, and
Real Property Tax Act
49Section 5.01 of the Real Property Tax Act, chapter R-2 of the Revised Statutes, 1973, is amended
(a) in subsection (1) in the definition “rate” by striking out “the tax rates referred to in paragraph 32(4)(c) of the Edmundston Act, 1998,”;
(b) by repealing paragraph (3)(c);
(c) by repealing paragraph (5)(b).
Regulation under the Regional Health Authorities Act
50Paragraph 6(2)(b) of New Brunswick Regulation 2012-7 under the Regional Health Authorities Act is amended by striking out “created” and substituting “continued”.
Commencement
51This Act comes into force on January 1, 2019.
