An Act to Amend the
Medical Services Payment Act
Assented to December 20, 2012
Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows:
1Section 8 of the Medical Services Payment Act, chapter M-7 of the Revised Statutes, 1973, is amended
(a) in subsection (1)
(i) by adding after paragraph (g) the following:
(g.01) personal information relating to a medical practitioner may be released to an agent of the provincial authority for the purpose of administering programs for the benefit of medical practitioners under an agreement referred to in subsection 4.1(1),
(ii) in paragraph (h) by striking out “any Act, or” and substituting “any Act,”;
(iii) by adding after paragraph (h) the following:
(h.1) personal information relating to a medical practitioner may be released to the New Brunswick Medical Society for the purpose of negotiating an agreement referred to in subsection 4.1(1), or
(b) by adding after subsection (2) the following:
8(3)If this section is inconsistent with or in conflict with a provision of the Right to Information and Protection of Privacy Act, this section prevails.
