1Section 10.3 of New Brunswick Regulation 94-47 under the Fish and Wildlife Act is amended
(a) by repealing subsection (1.1) and substituting the following:
10.3(1.1)For the purpose of issuing a non-resident conservation fundraising moose licence, the Minister may approve, for a period not exceeding three years, a hunting or fishing association or club incorporated under the Companies Act to conduct or hold the following fundraising activities each year:
(a) a raffle; or
(b) an auction.
(b) by adding after subsection (1.1) the following:
10.3(1.11)An association or club referred to in subsection (1.1) that intends to conduct a raffle or hold an auction, as the case may be, shall prepare a fundraising activity proposal for approval by the Minister by providing the information required by the Minister, in the manner that the Minister requires.
10.3(1.12)The Minister shall not issue a non-resident conservation fundraising moose licence to the winner of the raffle or the successful bidder of the auction under subsection (1.1), as the case may be, unless the association or club referred to in that subsection satisfies the Minister that the approved provisions of the fundraising activity proposal, as well as the provisions of any law or regulation applicable to the conducting of the raffle or the holding of the auction, are complied with.
(c) by repealing subsection (2) and substituting the following:
10.3(2)The Minister shall notify an association or club approved under subsection (1) or (1.1) that a resident conservation fundraising moose licence has been set aside for the winner of the raffle or that a non-resident conservation fundraising moose licence has been set aside for the winner of the raffle or the successful bidder of the auction, and the association or club, as the case may be, shall notify the Minister when the winner or the successful bidder has been selected.
(d) in subsection (3)
(i) by striking out the portion preceding paragraph (a) and substituting the following:
10.3(3)Subject to subsections (5) and (9), the winner of a raffle or the successful bidder of an auction, as the case may be, conducted or held by an association or club in any year, or a person acting on a winner’s or the bidder’s behalf,
(ii) in paragraph (b) by striking out “the winner” and substituting “the winner or the successful bidder”;
(e) by repealing subsection (5) and substituting the following:
10.3(5)The Minister shall not issue a resident conservation fundraising moose licence to a winner of a raffle or issue a non-resident conservation fundraising moose licence to a winner of a raffle or a successful bidder of an auction, as the case may be, unless the winner or the successful bidder, or the person obtaining the licence on behalf of the winner or the successful bidder,
(a) satisfies the Minister as to the winner’s or the successful bidder’s identity and as to the following by providing the unique identification number provided to the person under subsection 82.1(4) of the Act at the time of registration under section 82.1 of the Act or satisfies the Minister as to the winner’s or the successful bidder’s identity by presenting any identification and other documentation requested by the Minister:
(i) for the purposes of a resident conservation fundraising moose licence, the winner’s principal place of residence is within the Province;
(ii) for the purposes of a non-resident conservation fundraising moose licence, the winner’s or the successful bidder’s principal place of residence is not within the Province; and
(iii) the winner or the successful bidder is 18 years of age or older; and
(b) provides proof that the winner or the successful bidder successfully completed in the Province or elsewhere one of the following courses recognized by the Minister:
(i) a firearm safety and hunter education course; or
(ii) if hunting by bow or crossbow, a bow hunter education course.
(f) in subsection (6) in the portion preceding paragraph (a) by striking out “a winner” and “the winner” and substituting “a winner or a successful bidder” and “the winner and the successful bidder”, respectively;
(g) in subsection (7)
(i) in the portion preceding paragraph (a) by striking out “a winner” and “the winner” and substituting “a winner or a successful bidder” and “the winner or the successful bidder”, respectively;
(ii) in paragraph (a) of the English version by striking out “winner” and substituting “winner or the successful bidder”.
