REGULATION 2025-38

Local Governance Act

Subsection 10(1) of New Brunswick Regulation 2021-1 under the Local Governance Act is amended by striking out “October, 2021” and substituting
“October, 2026”
.

The Regulation is amended by adding after section 12 the following:
Electronic meetings of committee
12.1
(1)
It is permitted to use electronic means of communication in a meeting of the committee if it allows the representatives to hear and speak to each other.

(2)
A representative who participates in a meeting in the manner referred to in subsection (1) is deemed to be present at the meeting.

Section 15 of the Regulation is amended
(
a
)
in paragraph (2)(a) by striking out “six” and substituting
“eight”
;
(
b
)
in subsection (3) by striking out “three” wherever it appears and substituting
“four”
;
(
c
)
by adding after subsection (7) the following:

(7.1)
Despite subsection (7), if the term of a member of the Board referred to in paragraph (2)(a) has not expired on the commencement of this subsection, the term of that member shall be extended by one year.
(
d
)
by repealing subsection (8);
(
e
)
by repealing subsection (9).

Subsection 19(1) of the Regulation is amended by striking out “month of October” and substituting
“last three months of the calendar year”
.

Subsection 22(1) of the Regulation is amended by striking out “14 days” and substituting
“60 days”
.

Section 23 of the Regulation is amended by striking out “three” and substituting
“four”
.

The Regulation is amended by adding after section 23 the following:
Electronic meetings of Board
23.1
(1)
It is permitted to use electronic means of communication in a meeting of the Board if it allows the members to hear and speak to each other.

(2)
A member of the Board who participates in a meeting in the manner referred to in subsection (1) is deemed to be present at the meeting.

Section 29 of the Regulation is repealed.
Commencement
9
(1)
Subject to subsection (2), this Regulation comes into force on October 1, 2025.

(2)
Paragraphs 3(a) and (b) and section 6 of this Regulation come into force on October 1, 2026.
