1Section 2 of New Brunswick Regulation 2021-42 under the Early Childhood Services Act is amended by adding the following definition in alphabetical order:
“educator” means an operator or a staff member of a full-time early learning and childcare centre or a part-time early learning and childcare centre who is at least 16 years of age and who works directly with children.(éducateur)
2Section 3 of the English version of the Regulation is amended by striking out “online” and substituting “on-line”.
3Subsection 4(1) of the Regulation is amended
(a) by repealing the portion preceding paragraph a) of the French version and substituting the following:
4(1)L’exploitant d’un établissement agréé fournit au ministre, pour les besoins du registre en ligne, les renseignements qui suivent :
(b) by repealing paragraph (g);
(c) by adding after paragraph (k) the following:
(k.1) the daily fee to be charged to a child’s parents or guardians;
(k.2) the number of filled and unfilled educator positions;
(d) in paragraph (o) by striking out “the maximum number of children who may receive services and”.
4The Regulation is amended by adding after section 4 the following:
Information with respect to staff members
4.1An operator of a licensed facility shall provide the Minister with the following information with respect to each staff member for the on-line registry:
(a) the name of the staff member;
(b) the date of birth of the staff member;
(c) the e-mail address of the staff member;
(d) the preferred official language of communication of the staff member;
(e) the training documents of the staff member;
(f) the date of commencement of employment for the staff member;
(g) the hourly base wage of the staff member, excluding any wage enhancement grant;
(h) the licence number of each facility at which the staff member is employed; and
(i) the role or job title of the staff member.
Information with respect to enrolment of a child
4.2(1)An operator of a licensed facility shall provide the Minister with the following information with respect to the enrolment of each child for the on-line registry:
(a) the name of the child’s parents or guardians;
(b) the e-mail address of the child’s parents or guardians;
(c) the start date of services;
(d) the number of days per week that services are required;
(e) the licence number of the facility at which the child will receive services;
(f) the age group of the child; and
(g) the daily fee that will be charged to the child’s parents or guardians.
4.2(2)The Minister shall disclose to the parents or guardians of the child the information provided under subsection (1) to complete the enrolment of the child.
5Section 5 of the Regulation is repealed and the following is substituted:
5The information for the on-line registry shall be up to date at the time it is provided to the Minister and maintained on an ongoing basis.
6Section 6 of the Regulation is repealed and the following is substituted:
6The Minister may disclose to the operator of a licensed facility chosen by the parents or guardians of a child the following information in the on-line registry with respect to the child on the enrolment of the child at the facility:
(a) the names of the child and the child’s parents or guardians;
(b) the gender and date of birth of the child;
(c) the addresses of the child and the child’s parents or guardians and the living arrangements of the child;
(d) the e-mail addresses and telephone numbers of the child’s parents or guardians;
(e) the preferred official languages of communication of the child’s parents or guardians;
(f) the places of work of the child’s parents or guardians;
(g) the names of individuals authorized by the child’s parents or guardians to pick up the child;
(h) special requirements of the child, including activity and dietary restrictions, if applicable;
(i) the school that the child attends, if applicable;
(j) allergies of the child, if applicable;
(k) the name, address and telephone number of the medical practitioner of the child, if applicable;
(l) the medical history of the child;
(m) ongoing medical treatment of the child, if applicable;
(n) childcare history;
(o) child development details;
(p) likes and dislikes of the child and suggestions to facilitate the transition to the facility;
(q) the amount of assistance provided to the child’s parents or guardians;
(r) the number of days per week that services are required; and
(s) emergency contacts for the child, including names, addresses and telephone numbers.
