NEW BRUNSWICK
REGULATION 2024-81
under the
Financial Administration Act

1New Brunswick Regulation 83-227 under the Financial Administration Act is amended by adding after section 1 the following:
1.1In this Regulation, “Act” means the Financial Administration Act.
2Section 2 of the Regulation is amended
(a) in subsection (1) by striking out “Financial Administration Act” and “Memorandum to the Treasury Board” and substituting “Act” and “Memorandum to the Board”, respectively;
(b) in subsection (2)
(i) by striking out the portion preceding paragraph (a) and substituting the following:
2(2)A Memorandum to the Board or a request to the Secretary to the Board shall contain the following information:
(ii) in paragraph (a) by striking out “Minister or Deputy Minister” and substituting “head or deputy head”;
(c) by repealing subsection (3) and substituting the following:
2(3)After receiving a Memorandum to the Board, the Comptroller shall make a recommendation to the department.
(d) by adding after subsection (3) the following:
2(3.1)The department shall forward to the Board the recommendation the department received from the Comptroller, together with the Memorandum to the Board.
(e) by repealing subsection (4) and substituting the following:
2(4)After receiving a request to the Secretary to the Board, the Comptroller shall make a recommendation to the department.
(f) by adding after subsection (4) the following:
2(4.1)The department shall forward to the Secretary to the Board the recommendation the department received from the Comptroller, together with the request to the Secretary to the Board.
3Section 4 of the French version of the Regulation is amended by striking out “Ministre” and substituting “ministre”.
4Section 5 of the Regulation is amended
(a) in subsection (1) by striking out “Minister or Deputy Head” and substituting “head or deputy head”;
(b) in subsection (2) by striking out “Treasury Board” and substituting “Board”;
(c) in subsection (3) by striking out “Treasury Board” and substituting “Board”;
(d) in subsection (4) by striking out “Treasury Board” and substituting “Board”.
5 Section 6 of the Regulation is amended
(a) in subsection (1) by striking out “Minister of the department” and substituting “head of the department”;
(b) in subsection (3)
(i) in the portion preceding paragraph (a) by striking out “Minister” and substituting “head”;
(ii) in paragraph (c) of the English version by striking out “Minister” and substituting “head”;
(iii) in paragraph (d) of the English version by striking out “Minister” and substituting “head”;
(iv) in paragraph (e) of the English version by striking out “Minister determines” and substituting “head determines”;
(c) in subsection (4) by striking out “Minister” and substituting “head”.
6Subsection 7(1) of the Regulation is amended by striking out “Deputy Head” and substituting “deputy head”.
7Section 7.1 of the Regulation is amended by striking out “Minister” and “Treasury Board” and substituting “head” and “Board”, respectively.
8Section 7.2 of the Regulation is amended
(a) by repealing subsection (1);
(b) in subsection (2) of the English version
(i) in the portion preceding paragraph (a) by striking out “Deputy Head” and substituting “deputy head”;
(ii) in paragraph (a) by striking out “Deputy Heads” and substituting “deputy heads”;
(iii) in paragraph (b) by striking out “Deputy Head” and substituting “deputy head”;
(c) in subsection (3) of the English version by striking out “Deputy Head” wherever it appears and substituting “deputy head”;
(d) in subsection (5) by striking out “Treasury Board” and substituting “Board”.
9Section 7.3 of the Regulation is amended
(a) in subsection (1) by striking out “Minister or Deputy Head” and “Minister, but” and substituting “head or deputy head” and “head, but”;
(b) in subsection (2) by striking out “Minister” and “Treasury Board” and substituting “head” and “Board”, respectively;
(c) in subsection (3) by striking out “Treasury Board” and “Minister” and substituting “Board” and “head”, respectively;
(d) in subsection (4) by striking out “Treasury Board” and substituting “Board”;
(e) in subsection (5) by striking out “Minister” and substituting “head”;
(f) in subsection (7) by striking out “Treasury Board” and substituting “Board”.
10 Section 8 of the Regulation is amended
(a) in subsection (1) by striking out “Treasury Board” and substituting “Board”;
(b) by repealing subsection (3).
11Section 8.1 of the Regulation is amended by striking out “Financial Administration Act” and substituting “Act”.
12Section 9 of the Regulation is amended by striking out “Province of New Brunswick bank account” and substituting “bank account of the Province”.
13Section 10 of the Regulation is repealed and the following is substituted:
10(1)For the purposes of paragraph (a) of the definition “department” in section 1 of the Act, the departments referred to in Schedule A are prescribed.
10(2)For the purposes of paragraph (b) of the definition “department” in section 1 of the Act, the portions of the public service referred to in Schedule B are prescribed.
14Schedule B of the Regulation is repealed and the attached Schedule B is substituted.
Commencement
15This Regulation comes into force on April 1, 2025.
