Provincial Offences Procedure Act

1Subsection 3(1) of New Brunswick Regulation 91-50 under the Provincial Offences Procedures Act is amended by repealing paragraph (e.52) and substituting the following:
(e.52) an offence under subsection 3(1) or (3), 4(3) or 5(1), section 5.1 or 8 or subsection 9.1(2) or (3) of the COVID-19 Preventative Measures Regulation – Public Health Act;
2Schedule A of the Regulation is amended in the portion for COVID-19 Preventative Measures Regulation under the Public Health Act
(a) by striking out
4(2)
 failing to require proof of vaccination against COVID-19 or failing to require the wearing of a mask
and substituting the following: 
4(2)
failing to require proof of vaccination against COVID-19
(b) by adding after
5(1)
 failing to register with or provide proof of vaccination or medical exemption to the New Brunswick Travel Registration Program
the following: 
5.1
failing to report information or give instructions to close contacts within 24 hours
(c) by adding after

 knowingly make a false statement
the following: 
9.1(2)
failing to wear a mask in a public indoor space or an indoor workplace
9.1(3)
allowing a person into a public indoor space or an indoor workplace without wearing a mask
3 This Regulation comes into force on September 22, 2021.
