1Section 2 of New Brunswick Regulation 2010-19 under the Natural Products Act is amended
(a) in the definition “dairy farm” by striking out “cows” and substituting “dairy animals”;
(b) in the definition “milking parlour” by striking out “cows” and substituting “dairy animals”;
(c) by adding the following definition in alphabetical order:
“automatic milking system” means a system that milks animals without human intervention.(système de traite automatisé)
2The heading “Housing of calves” preceding section 5 of the Regulation is repealed and the following is substituted:
Housing of the young of dairy animals
3Section 5 of the Regulation is amended by striking out “Calves” and substituting “The young of dairy animals”.
4The heading “Entretien des alentours” preceding section 6 of the French version of the Regulation is repealed and the following is substituted:
Entretien des aires attenantes à l’étable laitière
5Section 6 of the Regulation is amended
(a) in the portion preceding paragraph a) of the French version by striking out “s’assure que” and substituting “veille à ce que”;
(b) in paragraph a) of the French version by striking out “les alentours de” and substituting “les aires attenantes à”;
(c) in paragraph (b) of the English version by striking out “and” at the end of the paragraph;
(d) by repealing paragraph b) of the French version and substituting the following:
(b) les animaux morts soient enlevés immédiatement de l’étable laitière ou des aires y attenantes;
(e) by repealing paragraph c) of the French version and substituting the following:

6Section 7 of the Regulation is amended
(a) in subsection (3) by striking out “cows” and substituting “dairy animals”;
(b) in subsection (4) by striking out “cows” and substituting “dairy animals”.
7Section 8 of the Regulation is amended
(a) in subparagraph (g)(i) by striking out “cows” and substituting “dairy animals”;
(b) in paragraph (h) by striking out “cow” and substituting “dairy animal”.
8Subsection 9(1) of the Regulation is amended
(a) in subparagraph (f)(i) by striking out “cows” and substituting “dairy animals”;
(b) in paragraph (j) by striking out “cows” and substituting “dairy animals”.
9Paragraph 15(2)(c) of the Regulation is repealed and the following is substituted:
(c) be accessible from an exterior entry point that does not require travel through animal traffic areas.
10Paragraph 19(1)(c) of the Regulation is amended by striking out “cows” and substituting “dairy animals”.
11Section 21 of the Regulation is amended
(a) in subsection (1)
(i) in paragraph (a) by striking out “the cow’s” and substituting “the dairy animal’s”;
(ii) in paragraph (b) by striking out “the cow’s” and substituting “the dairy animal’s”;
(iii) in paragraph (c) by striking out “the cow’s” and substituting “the dairy animal’s”;
(b) in subsection (2)
(i) in paragraph (a) by striking out “cows” and substituting “dairy animals”;
(ii) in paragraph (c) of the English version by adding “and” at the end of the paragraph;
(iii) in paragraph (d) by striking out “, and” at the end of the paragraph and substituting a period;
(iv) by repealing paragraph (e);
(c) by adding after subsection (2) the following:
21(3)If an automatic milking system is used, the person who conducts the milking operation shall ensure that the hair on the dairy animal’s udders, sides, flanks and tail are free of dirt and manure and that the system
(a) cleans and sanitizes the dairy animal’s teats and udder base,
(b) discards the first stream of raw milk from each teat, and
(c) detects and discards abnormal milk.
21(4)Immediately after milking, the person who conducts the milking operation shall sanitize the cow’s teats or shall ensure that the automatic milking system performs the sanitization using a teat dip solution approved for that purpose under the Food and Drugs Act (Canada) and its regulations.
12The heading “Cow Health” that follows the heading “Division F” of the Regulation is repealed and the following is substituted:

13The heading “Duty to ensure good health of cows” preceding section 22 of the Regulation is repealed and the following is substituted:
Duty to ensure good health of dairy animals
14Section 22 of the Regulation is amended
(a) in the portion preceding paragraph (a) by striking out “cows” and substituting “dairy animals”;
(b) in paragraph (a) of the English version by striking out “the cows’” and substituting “their”;
(c) in paragraph c) of the French version by striking out “exemptes” and substituting “exempts”.
15Section 23 of the Regulation is amended by striking out “cows” and “cow” and substituting “dairy animals” and “dairy animal”, respectively.
16Section 24 of the Regulation is amended
(a) in subsection (1) by striking out “cow” and substituting “dairy animal”;
(b) in subsection (2)
(i) in paragraph (a) by striking out “cow” and substituting “dairy animal”;
(ii) in paragraph (g) by striking out “the cow’s” and substituting “the dairy animal’s”;
(c) in subsection (3) by striking out “cow” and substituting “dairy animal”.
17Subsection 50(3) of the Regulation is amended by striking out “robotic milkers” and substituting “automatic milking systems”.
18Section 53 of the Regulation is amended
(a) by renumbering the section as subsection 53(1);
(b) by adding after subsection (1) the following:
53(2)In addition to the cooling requirements specified in this Regulation, sheep milk may be stored in a freezer if the following conditions are satisfied:
(a) milk that is to be frozen shall be frozen within 72 hours after milking and shall remain in a frozen state until delivered to a processor;
(b) raw milk shall be cooled to 4°C or less before it is added to a container of frozen milk;
(c) the freezer shall be equipped with an accurate temperature-measuring device;
(d) a daily record of the temperature of the freezer shall be kept;
(e) each container of milk shall be uniquely identified and the producer shall keep a record so that the milking dates and the name of the producer can be traced to that container;
(f) reusable milk storage containers shall be thoroughly cleaned, sanitized and dried after they are emptied and before they are used again;
(g) plastic bags, pail liners and other articles intended for single use shall be used only once and their containers shall be stored so that the exterior of the containers remains clean and free of contaminants; and
(h) the freezer and storage racks shall be
(i) free of pits and corrosion, and
(ii) maintained in a sanitary condition while in use.
19Section 54 of the Regulation is amended by striking out “the cow” and substituting “the dairy animal”.
20Subsection 55(1) of the Regulation is amended
(a) in paragraph (b) by striking out “cow” and substituting “dairy animal”;
(b) in paragraph (c) by striking out “cow” and substituting “dairy animal”.
21Section 58 of the Regulation is repealed and the following is substituted:
58(1)Raw milk from cows that has a somatic cell count in excess of 400,000 cells per millilitre shall be considered unacceptable.
58(2)Raw milk from goats that has a somatic cell count in excess of 1,500,000 cells per millilitre shall be considered unacceptable.
22Section 59 of the Regulation is repealed and the following is substituted:
59(1)When the freezing temperature of raw milk from cows is higher than -0.525 degrees Hortvet, water is presumed to have been added to it.
59(2)When the freezing temperature of raw milk from goats is higher than -0.554 degrees Hortvet, water is presumed to have been added to it.
