1Paragraph (2) of Rule 54.10 of the Rules of Court of New Brunswick, “TRIAL PROCEDURE”, New Brunswick Regulation 82-73 under the Judicature Act and the Provincial Offences Procedure Act, is repealed and the following is substituted:
(2)In the absence of evidence to the contrary, the discount rate to be used in determining the amount of an award in respect of future pecuniary damages is 2.5% per year.
2Tariff “D” of Rule 59 of the Rules of Court, “COSTS OF PROCEEDINGS BETWEEN PARTIES” is amended
(a) in section 1
(i) in paragraph (1) by striking out “$35.00” and substituting “$50”;
(ii) in paragraph (2)
(A) in clause (a) by striking out “20 cents” and substituting “40 cents”;
(B) in clause (b) by striking out “20 cents” and substituting “40 cents”;
(iii) in paragraph (3) by striking out “$30.00” and substituting “$75”;
(iv) by adding after paragraph (3) the following:
(4)If the assessing officer is satisfied that it is reasonable, the assessing officer may adjust the costs fixed under paragraphs (1), (2) and (3).
(b) in section 2
(i) in paragraph (4) by striking out “, up to $250.00”;
(ii) in paragraph (5) by striking out “, up to $75.00 per day, subject to increase by the assessing officer”;
(iii) in paragraph (14) by striking out “, when allowed by the assessing officer”.
3Form 62K of the Appendix of Forms to the Rules of Court is amended by striking out “to determine the status of this appeal.” and substituting “to determine the status of this appeal. To perfect an appeal that has not been perfected within the time prescribed for appeal, an order extending time for appeal must be obtained from a judge of the Court of Appeal.”.
4This Rule comes into force on October 1, 2014.
