REGULATION 2010-161

Natural Products Act

1Section 2 of New Brunswick Regulation 2003-84 under the Natural Products Act is amended
(a) by repealing the following definitions:
(i) “area”;
(ii) “zone”;
(b) in the definition “sow” in the English version by striking out the semicolon at the end of the definition and substituting a period.
2Section 3 of the Regulation is amended
(a) by adding after subsection (1) the following:
3(1.1)Only residents of the Province are eligible to be members.
(b) by repealing subsection (2);
(c) by repealing subsection (3);
(d) by repealing subsection (4);
(e) by repealing subsection (5).
3Subsection 5(4) of the Regulation is amended by striking out “annual zone meeting” and substituting “annual general meeting”.
4Section 6 of the Regulation is amended
(a) in subsection (1)
(i) by striking out the portion preceding paragraph (a) and substituting the following:
6(1)Subject to subsection (2), a person shall not hold office as a member unless the person
(ii) by repealing paragraph (b) and substituting the following:
(b) owns or leases production facilities in the Province, and
(b) in subsection (2)
(i) by striking out the portion preceding paragraph (a) and substituting the following:
6(2)A designated representative of an eligible producer may hold office as a member if
(ii) by repealing subparagraph (a)(iii) and substituting the following:
(iii) owns or leases production facilities in the Province, and
5Section 7 of the Regulation is amended
(a) in subsection (1)
(i) by striking out the portion preceding paragraph (a) and substituting the following:
7(1)Subject to subsection (2), a person shall not vote in an election for a member unless the person
(ii) by repealing paragraph (b) and substituting the following:
(b) owns or leases production facilities in the Province, and
(b) in subsection (2)
(i) by striking out the portion preceding paragraph (a) and substituting the following:
7(2)A designated representative of an eligible producer may vote in an election for a member if
(ii) by repealing subparagraph (a)(iii) and substituting the following:
(iii) owns or leases production facilities in the Province, and
6The heading “Annual zone meetings” preceding section 8 of the Regulation is repealed and the following is substituted:
Annual general meetings
7Section 8 of the Regulation is amended
(a) in subsection (1) by striking out “annual zone meeting” and substituting “annual general meeting”;
(b) in subsection (2) by striking out “annual zone meeting” and substituting “annual general meeting”;
(c) in subsection (3) by striking out “annual zone meeting” and substituting “annual general meeting”;
(d) in subsection (4) by striking out “annual zone meeting” and substituting “annual general meeting”;
(e) in subsection (5) by striking out “annual zone meeting” and substituting “annual general meeting”.
8Section 9 of the Regulation is amended
(a) in subsection (1) by striking out “annual zone meeting and substituting “annual general meeting”;
(b) by repealing subsection (3) and substituting the following:
9(3)An eligible producer or a designated representative of an eligible producer is entitled to vote once in relation to each membership position to be filled in each fiscal year.
(c) by repealing subsection (4);
(d) by repealing subsection (5);
(e) in subsection (6) by striking out “annual zone meeting” and substituting “annual general meeting”;
(f) in subsection (7) by striking out “annual zone meeting” and substituting “annual general meeting”.
9Section 10 of the Regulation is amended
(a) by repealing subsection (1) and substituting the following:
10(1)If a position on the Board is not filled after an election, a member becomes unwilling or unable to act as a member or a vacancy on the Board occurs for any other reason, the Board shall declare the position vacant and shall, subject to subsection 3(6), appoint a person qualified under section 6 as a member at its next regular meeting.
(b) by repealing subsection (2);
(c) by repealing subsection (3).
10Section 11 of the Regulation is repealed and the following is substituted:
11The Board may remove from office any member who
(a) has violated the Act, the regulations under the Act or an order of the Board or the Commission,
(b) has been convicted of an offence under the Criminal Code (Canada), or
(c) has failed to attend three consecutive meetings of the Board without reasonable excuse.
