New Brunswick Income Tax Act

1New Brunswick Regulation 2001-12 under the New Brunswick Income Tax Act is amended by adding after section 2 the following:
Definition of “regional project”
2.01In the Act, “regional project” means an eligible project for which more than 50% of the principal photography is done outside a radius of 50 kilometres from the city hall in The City of Fredericton, the city hall in Moncton and the city hall in The City of Saint John.
2Section 2.1 of the Regulation is amended by striking out “subsection 60(3)” and substituting “paragraph 60(3)(a)”.
3The Regulation is amended by adding after section 2.1 the following:
Rate for regional projects
2.2The rate for the purposes of paragraph 60(3)(b) of the Act is 10%.
4Section 3 of the Regulation is amended
(a) in subsection (1) by striking out “Minister of Business New Brunswick” and substituting “Minister of Wellness, Culture and Sport”;
(b) in subsection (2) by striking out “Minister of Business New Brunswick” and substituting “Minister of Wellness, Culture and Sport”;
(c) in subsection (3) by striking out “Minister of Business New Brunswick” and substituting “Minister of Wellness, Culture and Sport”.
5Paragraph 5(b) of the Regulation is amended by striking out “Minister of Business New Brunswick” and substituting “Minister of Wellness, Culture and Sport”.
6Section 6 of the Regulation is amended
(a) in subsection (1)
(i) by striking out “Minister of Business New Brunswick” wherever it appears and substituting “Minister of Wellness, Culture and Sport”;
(ii) in the French version by striking out “par ce Ministre” and substituting “par ce ministre”;
(b) in subsection (2) by striking out “Minister of Business New Brunswick” and substituting “Minister of Wellness, Culture and Sport”.
COMMENCEMENT
7(1)Sections 1 to 3 of this Regulation shall be deemed to have come into force on January 1, 2010.
7(2)Sections 4 to 6 of this Regulation shall be deemed to have come into force on April 1, 2009.
