1Section 2 of New Brunswick Regulation 2001-67 under the Motor Vehicle Act is amended
(a) in the definition “axle group” by striking out “or a triaxle” and substituting “, a triaxle or a quadrem axle”;
(b) by repealing the definition “tridem equivalent axle” and substituting the following:
“tridem equivalent axle” means an axle group on a vehicle that is made up of three consecutive, equally spaced axles within a vehicle and that has(essieu tridem équivalent)
(a) all lift axles lowered,
(b) the same number and size of tires on each axle, and
(c) each of its axles attached by identical pneumatic suspensions that automatically provide load equalization;
(c) by adding the following definitions in alphabetical order:
“dry bulk product” means unpacked free flowing dry solids that are loaded without being boxed, bagged or hand stowed;(produits secs en vrac)
“general freight” means any substance, article or thing conveyed in or on a vehicle; (marchandise générale)
“liquid bulk product” means unpacked free flowing liquids that are loaded in an approved tanker trailer without being placed in bottles, bags, boxes, barrels, small tanks, or in any other similar container, and without being hand stowed;(produits liquides en vrac)
“quadrem axle” means an axle group on a semi-trailer consisting of four consecutive axles;(essieu quadrem)
“raw forest product” means a wood product that has not been subject to processing, other than it being cut from the stump, the removal of its limbs or bark or it being cut into sections, and includes wood chips and forest by-products;(produit forestier brut)
2Section 3 of the Regulation is amended
(a) in subsection (1) by striking out “an intercity bus” and substituting “an intercity bus, a motor home”;
(b) by striking out subsection (2) and substituting the following:
3(2)Subject to subsections (4), (4.1), subparagraphs 12.1(1)(d)(iii) and (iv) and subsection 12.1(2), no person shall operate or move and no owner shall permit to be operated or moved on a highway a truck, truck tractor, trailer, semi-trailer or any combination of such vehicles, an intercity bus, motor home or any other vehicle with axle spreads, interaxle spacings or wheelbases that exceed the maximum axle spreads or wheelbases or are less than the minimum axle spreads, interaxle spacings or wheelbases, as the case may be, that are set out in Schedule A for that type of vehicle or for the configuration for that type of vehicle.
(c) in subsection (4) by striking out “or any combination of such vehicles” and substituting “or any combination of such vehicles other than a truck tractor in combination with a quadrem axle semi-trailer”;
(d) by striking out subsection (4.2).
3Section 6 of the Regulation is amended
(a) in subsection (1) by striking out “an intercity bus” and substituting “an intercity bus or a motor home”;
(b) by repealing subparagraph (4)(b)(i).
4Section 7 of the Regulation is amended
(a) in paragraph (1)(c) by striking out “an intercity bus” and substituting “an intercity bus or a motor home”;
(b) by repealing subsection (2) and substituting the following:
7(2)Subject to subsections (3) and (4), a maximum mass that exceeds that permitted under paragraph (1)(a), (b) or (c) for the single steering axle of a truck tractor, truck, intercity bus or motor home is permitted if the owner of the truck tractor, truck, intercity bus or motor home submits to the Registrar a written application to register the vehicle with a greater gross axle mass.
(c) in paragraph (3)(b) by striking out “section 15.1” and substituting “subsection 15(1)”;
(d) in subsection (4) in the portion preceding paragraph (a) by striking out “or an intercity bus” and substituting “, an intercity bus or a motor home”;
(e) in subsection (5)
(i) in paragraph (b) by striking out “(a) and (c) to (f)” and substituting “(a), (d) and (e)”;
(ii) by repealing paragraph (c);
(iii) in paragraph (e) by striking out “until January 1, 2010,”;
(iv) by repealing paragraph (f);
(f) in subsection (8) by striking out “an intercity bus” and substituting “an intercity bus or a motor home”.
5Section 8 of the Regulation is amended
(a) in subsection (1) by striking out “Subject to subsections (3) and (4)” and substituting “Subject to subsections (3) and (4) and subparagraph 12.1(1)(e)(ii)”;
(b) in subsection (3)
(i) in paragraph (b) by striking out “until January 1, 2010,”;
(ii) by repealing paragraph (c);
(iii) in paragraph (e) by striking out “subject to paragraph (f),”;
(iv) by repealing paragraph (f);
(v) by repealing paragraph (g) and substituting the following:
(g) a triaxle that is on a trailer that is of a model year of 2002 or earlier shall be considered to be three axles,
(vi) by repealing paragraph (h);
(vii) by repealing paragraph (i);
(viii) by repealing paragraph (j) and substituting the following:
(j) a triaxle that is on a trailer that is of a model year of 2003 or later shall be considered to be two axles.
6Subsection 9(1) of the Regulation is amended by striking out “subsection (3)” and substituting “subsection (3) and sections 12.1 and 12.2”.
7The Regulation is amended by adding after section 12 the following:
Truck tractor and quadrem axle semi-trailer not equipped with self-steering axle
12.1(1)No person shall operate or move and no owner shall permit to be operated or moved on a highway a truck tractor and quadrem axle semi-trailer not equipped with a self-steering axle if the vehicle does not satisfy the following requirements:
(a) the last three axles of the semi-trailer are a tridem axle, none of which is a liftable axle;
(b) the semi-trailer has four tires on each axle that are attached to the vehicle in a manner achieving load equalization among all axles;
(c) subject to subparagraph (d)(iv), the axle spread of the quadrem axle semi-trailer shall be at least 3.65 m;
(d) if the semi-trailer is transporting longitudinally loaded logs, wood chips or forest by-products and has a mass greater than 28 000 kg,
(i) the tridem axle shall be equipped with pneumatic suspensions,
(ii) the semi-trailer’s fourth axle shall be connected to the tridem axle by a pneumatic system,
(iii) the interaxle spacing between the fourth axle and the tridem axle shall be at least 2.4 m, and
(iv) the axle spread of the quadrem axle shall not be at least 5.4 m; and
(e) if the semi-trailer is transporting dry bulk products or liquid bulk products,
(i) axle group mass shall not exceed 26 000 kg, and
(ii) gross vehicle mass shall not exceed 49 500 kg.
12.1(2)If a truck tractor and quadrem axle semi-trailer not equipped with a self-steering axle is transporting general freight, other than longitudinally loaded logs, wood chips or forest by-products, and has a mass greater than 28 000 kg, there are no requirements with respect to the tridem axle spread.
12.1(3)Despite any other provision in this Regulation, no person shall operate or move and no owner shall permit to be operated or moved on a highway a truck tractor and quadrem axle semi-trailer not equipped with a self-steering axle after December 31, 2014.
Truck tractor and quadrem axle semi-trailer equipped with self-steering axle
12.2No person shall operate or move and no owner shall permit to be operated or moved on a highway a truck tractor and quadrem axle semi-trailer equipped with a self-steering axle if the vehicle does not satisfy the following requirements:
(a) the self-steering axle of the semi-trailer shall
(i) be located in the front of the tridem axle and be pneumatically connected to the tridem axle,
(ii) be equipped with
(A) two tires, each with a tire width of at least 365 mm, with the last three axles achieving a load equalization between each adjacent axle to within 1 000 kg, or
(B) four tires, with four axles achieving a load equalization between each adjacent axle to within 1 000 kg;
(b) if the self-steering axle of the semi-trailer is liftable, the controls for raising or lowering the axle shall be located on the semi-trailer, except for a semi-trailer designed to carry raw forest products, in such case the controls may be located within the cab of the truck tractor;
(c) the tridem axle of the semi-trailer shall
(i) have four tires on each axle,
(ii) be made up of the last three axles,
(iii) not be liftable, and
(iv) be equipped with a pneumatic suspension;
(d) the semi-trailer shall be equipped with a device that accurately displays the total weight on the semi-trailer’s axles in kilograms or with a device and a table or a chart allowing the total weight on the semi-trailer’s axles in kilograms to be easily read and accurately obtained;
(e) if the semi-trailer is designed to transport liquid bulk products, the semi-trailer shall be equipped with an electronic vehicle stability system;
(f) the truck tractor shall be equipped with manual controls that allow the self-steering axle to be raised to provide emergency drive axle traction at the same time as the hazard warning lights are activated; and
(g) the manual controls referred to in paragraph (f) shall include a device that does not allow the self-steering axle to be raised at a speed greater than 60 km/h.
8Schedule A of the Regulation is repealed and the attached Schedule A is substituted.
