1Section 27.2 of New Brunswick Regulation 83-42 under the Motor Vehicle Act is repealed and the following is substituted:
27.2(1)The following devices are prescribed for the purposes of the definition “provincially approved screening device” in subsection 310.02(1) of the Act and for the purposes of subsection 310.02(14) of the Act:
(a) Alcolmeter S-L2;
(b) Alcotest® 7410 GLC;
(c) Alcotest® 7410 PA3;
(d) BAC Datamaster C;
(e) Breathalyzer®, Model 900;
(f) Breathalyzer®, Model 900A; and
(g) Intox EC/IR II.
27.2(2)An analysis of a sample of breath by a device listed in subsection (1) shall produce a result indicating the presence of alcohol in samples of breath in the following manner:
(a) on the Alcolmeter S-L2, by showing a red light indicating “FAIL” or by showing a red light and a yellow or orange light indicating “WARN”;
(b) on the Alcotest® 7410 GLC, by producing a reading of “F”, a reading of “A” or a digital reading showing any number exceeding 0.00%;
(c) on the Alcotest® 7410 PA3, by producing a reading of “F”, a reading of “A” or a digital reading showing any number exceeding 0.00%;
(d) on the BAC Datamaster C, by a digital reading showing the number of milligrams of alcohol per 100 millilitres of blood exceeding zero;
(e) on the Breathalyzer®, Model 900, by indicating on the dial that the number of milligrams of alcohol per 100 millilitres of blood exceeds zero;
(f) on the Breathalyzer®, Model 900A, by indicating on the dial that the number of milligrams of alcohol per 100 millilitres of blood exceeds zero; and
(g) on the Intox EC/IR II, by a digital reading showing the number of milligrams of alcohol per 100 millilitres of blood exceeding zero.
