Petroleum Products Pricing Act

1Section 2 of New Brunswick Regulation 2006-41 under the Petroleum Products Pricing Act is amended
(a) in the definition “base product” by striking out “Bloombergs” and substituting “Bloomberg”;
(b) by repealing the definition “Bloombergs” and substituting the following:
“Bloomberg” means Bloomberg Oil Buyer’s Guide.(Bloomberg)
(c) by repealing the definition “Platts” and substituting the following:
“Platts” means Platts US Marketscan.(Platts)
2Section 4 of the Regulation is amended
(a) by repealing paragaph 4(1)(f) and substituting the following:
(f) for propane - the daily price for the corresponding base product set out in Schedule A, averaged over the 7 day period immediately preceding each Wednesday.
(b) by repealing subsection (2) and substituting the following:
4(2)For the purposes of calculating the benchmark price for furnace oil or motor fuel over a 7 day period, the daily high and low prices attributed to a base product for any day that the necessary price information is not published shall be deemed to be the prices most recently published.
(c) by adding after subsection (2) the following:
4(2.1)For the purpose of calculating the benchmark price for propane over a 7 day period, the daily price to be attributed to the base product for each day shall be the average price most recently published.
3Section 6 of the Regulation is amended
(a) in subsection (5)
(i) by repealing paragraph (a) and substituting the following:
(a) shall not use any deemed prices for any day that the necessary price information is not published as provided for under subsection 4(2),
(ii) in paragraph (b) by striking out “on the day” and substituting “on any day”;
(b) by repealing subsection (6) and substituting the following:
6(6)Subsection (5) and subsections 4(1) and (2) do not apply where the circumstances referred to in subsection (1) occur on a Tuesday.
4Subsection 19(1) of the Regulation is amended
(a) in paragraph (e) by striking out the period and substituting a semicolon;
(b) by adding after paragraph (e) the following:
(f) such other information the Board may require with respect to the sale of motor fuel products.
5Subsection 20(1) of the Regulation is amended
(a) in paragraph (d) by striking out the period and substituting a semicolon;
(b) by adding after paragraph (d) the following:
(e) such other information the Board may require with respect to the sale of heating fuel products.
6Schedule A of the Regulation is repealed and the attached Schedule A is substituted.
7Schedule C of the Regulation is amended by striking out the following:
