Under section 23 of the
Change of Name Act
, the Lieutenant-Governor in Council makes the following Regulation:

This Regulation may be cited as the
General Regulation

Change of Name Act
.

In this Regulation
“Act”
means the
Change of Name Act
.
(Loi)
GENERAL

(1)
Subject to subsection (3), the Registrar General shall not dispose of any material or information received or maintained in relation to an application under section 4 or 5 of the Act until twenty years have expired after the date of receipt of the application where
(
a
)
the application is granted by the Registrar General,
(
b
)
the application is refused by the Registrar General,
(
c
)
the Registrar General is unable to proceed and there is an order of a judge under section 11 of the Act granting the application,
(
d
)
the Registrar General is unable to proceed and there is an order of a judge under section 11 of the Act refusing the application,
(
e
)
the registration of the change of name is annulled by the Registrar General under section 12 of the Act,
(
f
)
the registration of the change of name is annulled by an order of a judge under section 12 of the Act,
(
g
)
there is an appeal under section 13 of the Act and the judge, by order, dismisses the appeal, or
(
h
)
there is an appeal under section 13 of the Act and the judge, by order, allows the appeal and
(i
)
sets aside the decision or order of the Registrar General, or
(ii
)
substitutes the decision or order of the Registrar General with that of the judge.

(3)
The Registrar General may transfer any material or information referred to in subsection (1) to the Provincial Archives at any time more than three years after the date of receipt of the application.

(1)
For the purposes of paragraph 9(
b
) of the Act, proposed given names and surnames included in a change of registered name form shall
(
a
)
contain only
(i
)
characters from the Roman alphabet, and
(ii
)
accents from the French language, if applicable, and
(
b
)
not be longer than
(i
)
38 characters in the case of a given name, and
(ii
)
30 characters in the case of a surname.

(2)
For the purposes of paragraph 9(
c
) of the Act, a proposed registered name shall not reasonably be expected to cause mistake or confusion.

(3)
For the purpose of paragraph 9(
d
) of the Act, an application to change the registered name of a person shall not be sought for a fraudulent or other improper purpose.

4.2
(1)
For the purposes of paragraph 11(7)(
b
) of the Act, proposed given names and surnames included in a change of registered name form shall
(
a
)
contain only
(i
)
characters from the Roman alphabet, and
(ii
)
accents from the French language, if applicable, and
(
b
)
not be longer than
(i
)
38 characters in the case of a given name, and
(ii
)
30 characters in the case of a surname.

For the purposes of paragraph 11(7)(

An index referred to in subsection 17(4) of the Act shall contain the registration number and the following information relating to the person whose registered name is changed:
(
a
)
place of birth;
(
b
)
date of birth;
(
c
)
birth registration number;
(
d
)
name before change;
(
e
)
name after change;
(
f
)
date of change; and
(
g
)
address, including postal code.

(1)
On and after April 3, 2017, the fees payable under the Act are as follows:
(
a
)
for an application under subsection 4(1) of the Act to change
(i)
a registered given name

(2)
With respect to an application fee referred to in subparagraph (1)(
a

)(i) or (ii), $50 is non-refundable if the application is withdrawn or rejected.
