70.4If the Commission or the Executive Director considers it to be in the public interest, the Commission or the Executive Director may make a decision with respect to the following:
(a)
the trading of derivatives or classes of derivatives on or through the facilities of an exchange or of a derivatives trading facility;
(b)
the clearing of trades of derivatives or classes of derivatives through the facilities of a clearing agency; and
(c)
the reporting of trades of derivatives or classes of derivatives to or through the facilities of a trade repository.
