Right to appeal
75(1)If the head of the public body decides not to accept the recommendation of the Ombud, the person who made the complaint may appeal the matter, in accordance with the regulations, to a judge of The Court of King’s Bench of New Brunswick.
75(2)If the person does not exercise his or her right to appeal under subsection (1), the Ombud may, on his or her own motion, appeal the matter, in accordance with the regulations, to a judge of The Court of King’s Bench of New Brunswick.
75(3)The head of the public body shall notify the person who made the complaint of the head of the public body’s decision not to accept the recommendation of the Ombud, the person’s right to appeal the decision and the time limit for the appeal.
75(4)Section 66 applies with the necessary modifications in relation to an appeal under subsection (1).
