Disclosure for enforcement purposes
41(1)A custodian may disclose personal health information, including information relating to a person providing health care, without the consent of the individual to whom the information relates to a person carrying out an inspection, investigation or similar procedure that is authorized by or under this Act, another Act of the Legislature or the Parliament of Canada for the purpose of facilitating the inspection, investigation or similar procedure.
41(2)A custodian may disclose personal health information, including information relating to a person providing health care, without the consent of the individual to whom the information relates to another custodian if the custodian disclosing the information has a reasonable expectation that disclosure will detect or prevent fraud, limit abuse in the use of health care or prevent the commission of an offence under an Act of the Legislature or the Parliament of Canada.
