Substitute consent under the
Mental Health Act 25.1Despite section 25, with respect to an involuntary patient who has not reached the age of 16 years, or who has reached the age of 16 years but is not mentally competent to give or refuse to give consent, the substitute decision-maker of the person is determined in accordance with section 8.6 of the Mental Health Act, with the necessary modifications.
