124(3)Where the officer in charge is in a position of authority over the peace officer who made the arrest and is of the opinion that it is no longer necessary in the public interest, having regard to all of the circumstances including those circumstances referred to in paragraphs 119(2)(
a), (
b), (
c) and (
d), to detain the person arrested, the officer in charge shall release the person and may serve the person with an appearance notice, a ticket or a violation ticket.
