40Where the geographical area of a regional service commission includes a municipality or a city to which subsection 35(1) or (2) applies, the regional service commission is subject to the obligations imposed by section 41 irrespective of the percentage required under section 39.

40Where the geographical area of a Planning Commission or of a Solid Waste Commission includes a municipality or a city to which subsection 35(1) or (2) applies, the Planning Commission or the Solid Waste Commission, as the case may be, is subject to the obligations imposed by section 41 irrespective of the percentage required under section 39.
