320Subject to section 325, where a person obtains in any court in the Province a judgment
(a)
against an owner of a motor vehicle or a driver of a motor vehicle, other than a motor vehicle owned by or under the care or control of the person, for damages for injuries to or the death of any person or damage to property, arising out of the operation, care or control of the motor vehicle in the Province, or
(b)
against a Party Unknown, as contemplated by section 329, for damages for injury to or the death of any person arising out of the operation, care or control of a motor vehicle in the Province,
upon the determination of all proceedings, including appeals, the person may apply to the Minister for payment out of the Fund of the amounts in respect of the judgment to which he is entitled pursuant to the provisions of this Part.
