195(1)No fiat shall be granted for a writ of habeas corpus, and no order shall be made under section 5 of the Habeas Corpus Act, unless the applicant applies for and obtains an order on judicial review to bring up the proceedings in the cause or matter in which the writ of habeas corpus, or order under that Act is applied for, and no judge shall proceed with any hearing upon a return to a writ of habeas corpus, or to an order under that Act, until he has before him all the proceedings, including the evidence.
