Administration of deposit
57(1)Where an insured person has filed a claim for a loss covered by the contract that occurred before the termination date fixed pursuant to section 50, the receiver shall inquire into the claim, and
(a) may approve the claim if a final judgment has been obtained against the insurer in respect thereof,
(b) may approve the claim if it has been adjusted or settled by the insurer or by the receiver at an amount that in his opinion the claimant is reasonably entitled to receive, or
(c) may refuse to approve the claim or the amount thereof.
57(2)An appeal shall lie from any decision of the receiver if taken within thirty days from the date on which the person appealing receives notice of the decision.
57(3)The appeal shall be taken by service on the receiver and by the filing of a notice of motion returnable before a judge of The Court of Queen’s Bench of New Brunswick in chambers who may summarily determine the matter or may direct an issue to be tried or may make such other order as he deems proper.
