Definitions
43In sections 44 to 70 inclusive,
“insured person” means a person who enters into a subsisting contract of insurance with an insurer and includes:(assuré)
(a) every person insured by a contract whether named or not,
(b) every person to whom or for whose benefit all or part of the proceeds of a contract of insurance are payable, and
(c) every person entitled to have insurance money applied toward satisfaction of his judgment in accordance with section 250;
“loss” includes the happening of an event or contingency by reason of which a person becomes entitled to a payment under a contract of insurance of money other than a refund of unearned premiums;(sinistre)
“New Brunswick contract” means a subsisting contract of insurance that(contrat du Nouveau-Brunswick)
(a) has for its subject,
(i) property that at the time of the making of the contract is in New Brunswick or is in transit to or from New Brunswick, or
(ii) the life, safety, fidelity or insurance interest of a person who at the time of the making of the contract is resident in New Brunswick or of an incorporated company that has its head office in New Brunswick, or
(b) makes provision for payment thereunder primarily to a resident of New Brunswick or to an incorporated company that has its head office in New Brunswick;
“reciprocal deposit” means a deposit of an insurer held pursuant to section 66 or 67;(dépôt réciproque)
“reciprocating province” means a province that has been declared to be a reciprocating province pursuant to paragraph 66(1)(a) or subsection 67(1) with respect to the deposit of a particular insurer.(province avec convention de réciprocité)
