Contract evidenced by non-owner’s policy
233Every contract evidenced by a non-owner’s policy insures the person named therein and such other person, if any, as is specified in the policy against liability imposed by law upon the insured named in the contract or that other person for loss or damage,
(a)
arising from the use or operation of an automobile within the definition thereof in the policy, other than an automobile owned by him or registered in his name, and
(b)
resulting from bodily injury to or the death of any person, and damage to property.
