Domicile or residence requirements
87(1)The court may hear an application and may make an adoption order where, at the time the adoption order is made,
(a)
the person to be adopted is domiciled or resident in the Province;
(b)
where the person to be adopted is under the age of majority, the parent of the person to be adopted is domiciled or resident in the Province; or
(c)
the prospective adopting parent is domiciled or resident in the Province.
87(2)Notwithstanding subsections 4(4) and (5) of
An Act Respecting Compliance of the Laws of the Province with the Canadian Charter of Rights and Freedoms, 1985, a child in care shall be deemed to be domiciled within the Province.
