Application for order where adult is discharged from psychiatric facility
37.2Where
(a)
an adult is scheduled to be discharged from a psychiatric facility or any other facility where the adult has been receiving care and supervision,
(b)
there is no member of the adult’s immediate family or any other person who is capable of and willing to assume responsibility for the adult’s care and supervision,
(c)
the Minister has reason to believe that the person is mentally incompetent, and
(d)
the adult is, in the opinion of the Minister, likely to become a neglected adult or an abused adult,
the Minister may apply for and the Court may make an order under subsection 39(1) on the basis that the person would be a neglected adult upon discharge from the facility.

the Minister of Families and Children or the Minister of Seniors and Long-Term Care, as the case may be, has reason to believe that the person is mentally incompetent, and
(d)
the adult is, in the opinion of the Minister of Families and Children or the Minister of Seniors and Long-Term Care, as the case may be, likely to become a neglected adult or an abused adult,
the Minister of Families and Children or the Minister of Seniors and Long-Term Care, as the case may be, may apply for and the Court may make an order under subsection 39(1) on the basis that the person would be a neglected adult upon discharge from the facility.
