Disposition of unexpended amount
136If money remitted to the court, any agency or person or to the Minister as a result of a support order remains unexpended, the court, if satisfied that none of the expenses contemplated by the support order remain unpaid, may order that
(a) the unexpended amount be remitted to the child or the parent having custody, whichever appears to be in the child’s best interests after any expenses incurred by the Minister on behalf of the child have been paid; or
(b) where the directions of paragraph (a) cannot be carried out, and there remains an unexpended amount, the money be refunded to the person against whom the order was made, if this is feasible; or
(c) where the person referred to in paragraph (b) cannot be located, the unexpended amount be deposited with the Minister of Finance, in which case it shall be disposed of as the Lieutenant-Governor in Council determines.
