Imposition of surcharge
123.4(1)Where a support order is filed with the court under section 122.2 or where an amount has been ordered to be paid into court under a support order, a surcharge of three per cent of the amount ordered to be paid under the support order shall be deemed to have been imposed against the person against whom the support order was made and shall be collected with and in the same manner as the amount ordered to be paid under the support order.
123.4(2)Subsection (1) does not apply to a person who is exempted by regulation from payment of the surcharge.
123.4(3)The surcharge referred to in subsection (1) is payable to the Minister of Finance for deposit in the Consolidated Fund.
123.4(4)If the surcharge imposed under this section is not paid at the time provided for payment of the amount ordered to be paid under a support order, the provisions for the enforcement of support orders under this Part apply to the collection of payment of the surcharge.
123.4(5)For the purposes of the provisions of this Act relating to the enforcement of support orders, any reference to an amount due under a support order shall be deemed to be a reference to the sum that represents the combined total of the amount due under the support order and the surcharge imposed under this section.
