Obligation to file a statement of financial information and appear before court administrator
123.2(1)Where an amount ordered to be paid under a support order is not paid in relation to a support order filed with the court under section 122.2 or to a support order under which an amount has been ordered to be paid into court, a court administrator may require the person against whom a support order was made
(a) to file a statement of financial information as prescribed by regulation or the Rules of Court with the court administrator, and
(b) to appear before the court administrator, in accordance with the Rules of Court, to be examined in relation to employment income, assets and financial circumstances for the purpose of enforcing the support order.
Obligation to file a statement of financial information and appear before court administrator
123.2(2)Where the court administrator requires a person to file a statement of financial information under paragraph (1)(a), the person shall file the statement within fifteen days after being served notice of the requirement to file the financial information.
Attendance by a person able to give material evidence
123.2(3)The court administrator may, in accordance with the Rules of Court, require any person to appear before the court administrator if the court administrator is satisfied that the person is able to give evidence material to the enforcement of the support order.
Authority of court administrator
123.2(4)The court administrator may
(a) make an order under section 123.3,
(b) require the person against whom a support order has been made to appear before the court for the purposes of a hearing under section 123,
(c) adjourn the hearing, with or without conditions, or
(d) do any or all of the above.
Filing of particulars of non-payment with the court
123.2(5)Where the court administrator requires the attendance of the person before the court under paragraph (4)(b), the court administrator shall prepare and file a report with the court setting out particulars of the non-payment of the support order.
