Provincial information banks
121.1(1)In this section
“Minister” means such members of the Executive Council who are designated by regulation and includes persons designated under subsection (2).
121.1(2)The Minister may designate persons to act on behalf of the Minister for the purposes of this section.
121.1(3)The provincial information banks that may be searched for the purposes of this section are the provincial information banks designated by regulation.
121.1(4)Where an amount ordered to be paid under a support order is not paid in relation to a support order filed with the court under section 122.2 or to a support order under which an amount has been ordered to be paid into court, a provincial enforcement service may apply to the Minister to have a provincial information bank searched and to have the information released.
121.1(5)An application under subsection (4) shall be accompanied by the information and documents required by regulation.
121.1(6)Where the information requested in an application is found in a provincial information bank and is the kind of information that may be released, the Minister shall release the information to the provincial enforcement service.
121.1(7)Information obtained from a provincial information bank under this section shall be sealed in the court file and shall not be disclosed except
(a) to a provincial enforcement service in another jurisdiction, or
(b) to a sheriff for the purposes of enforcement of an order for support.
121.1(8)The release and disclosure of information under this section for the purposes of this section shall be deemed not to be a contravention of any Act or regulation or any common law rule of confidentiality.
121.1(9)Subject to the provisions of any other Act which provides for the release or disclosure of information found in a designated provincial information bank, no person shall release information found in a provincial information bank or disclose information provided under this section except in accordance with this section and the regulations.
