30.1Where a conservation officer or assistant conservation officer seizes anything referred to in subsection 29(2) or section 30, the conservation officer or assistant conservation officer, as the case may be, shall return the thing seized to the owner or person in possession at the time of the seizure
(a)
if the person is not charged with an offence under this Act or the regulations, or
(b)
within thirty days after the final disposition of the charge
(i)
if the person has been charged with an offence under this Act or the regulations and no conviction results from that charge, or
(ii)
if the person has been charged with an offence under this Act or the regulations and is convicted but the judge does not order the forfeiture of the thing seized.
