Prosecution of an offence under section 43
51.91In a prosecution of an offence under section 43, the following is proof, in the absence of evidence to the contrary, that the credit card issuer issued the credit card to the individual named in the information:
(a)
evidence that the name of the accused credit card issuer appears on the face of a credit card alleged to have been issued to the individual named in the information; and
(b)
evidence that the name appearing on the face of the credit card as the name of the individual to whom it was issued is the same name as the individual alleged in the information to have been issued the credit card.
