10.8Where a matter is referred or appealed to a judge of The Court of King’s Bench of New Brunswick, the judge shall award costs in favour of the applicant
(a)
where the applicant is successful, or
(b)
where the applicant is not successful, if the judge considers it to be in the public interest.
10.8Where a matter is referred or appealed to a judge of The Court of Queen’s Bench of New Brunswick, the judge shall award costs in favour of the applicant
(a)
where the applicant is successful, or
(b)
where the applicant is not successful, if the judge considers it to be in the public interest.
