18(1)There is hereby constituted a Medical Assessment Advisory Committee which shall consist of
(a) a chairman appointed by the Minister to be such person, being a medical practitioner, as the Minister and the New Brunswick Medical Society mutually agree, and
(b) four members appointed by the Minister from persons nominated by the New Brunswick Medical Society and who are medical practitioners under the Medical Act.
18(2)The chairman shall hold office for such time, not exceeding three years, as may be agreed upon and may be reappointed after the expiry of the term of office.
18(3)Each member of the Medical Assessment Advisory Committee shall be appointed for an initial term of from one to three years, in the discretion of the Minister, and may, on the expiry of such initial terms, be reappointed for the subsequent term of three years.
18(4)The chairman and the members of the Medical Assessment Advisory Committee shall serve without salary, but may be reimbursed
(a) such actual travelling and other necessary out-of-pocket expenses, and
(b) for attendance at meetings on a per diem basis or any part thereof,
at such rate as may be approved by the Minister.
18(5)The provincial authority shall refer to the Medical Assessment Advisory Committee for review by it, the assessment of an account for entitled services concerning which dissatisfaction had been expressed by the person requesting the review under subsection 17(1), and may refer any other account respecting entitled services provided by a medical practitioner or an oral and maxillofacial surgeon to the Medical Assessment Advisory Committee.
18(6)The Medical Assessment Advisory Committee shall
(a) from time to time review and make recommendations on the method of assessing accounts for payment for entitled services provided to beneficiaries by medical practitioners or oral and maxillofacial surgeons, and
(b) review the assessment of accounts for payment for entitled services provided to beneficiaries by medical practitioners or oral and maxillofacial surgeons that are referred to it by the provincial authority and make recommendations concerning the assessment of such accounts to the provincial authority.
18(7)The Medical Assessment Advisory Committee shall provide to the New Brunswick Medical Society
(a) copies of its recommendations made pursuant to paragraph (6)(a), and
(b) generally, any relevant information respecting the method of assessing accounts
provided that no information shall be communicated which might disclose an individual account.
18(7.1)Subsection (7) does not apply to oral and maxillofacial surgeons.
