Silicosis Compensation Act

Right to payment
1(1)The Workplace Health, Safety and Compensation Commission shall make a monthly payment to a workman or his widow at the rate prescribed by regulation if, in the opinion of the Workplace Health, Safety and Compensation Commission, the workman
(a) is or becomes disabled and cannot continue his ordinary occupation because he contracted silicosis in the course of his employment in New Brunswick before June 1, 1948, or
(b) dies or has died after June 1, 1948 because he contracted silicosis in the course of his employment in New Brunswick before June 1, 1948.
1(2)When a workman to whom payment has been awarded under this Act dies or has died, payment at the rate prescribed by regulation shall be made to his widow during her lifetime or until she remarries.
1(3)If a widow remarries, payment at the rate prescribed by regulation shall cease but she shall be entitled in place of that payment to a sum equal to one year’s payments.

Duty of Minister respecting payments and expenses
2The Minister of Finance shall pay out of the Consolidated Fund
(a) all money required by the Workplace Health, Safety and Compensation Commission under section 1, and
(b) all expenses of the Workplace Health, Safety and Compensation Commission in connection with the physical examination of a workman who claims he is disabled and cannot continue his ordinary occupation because he contracted silicosis in the course of his employment in New Brunswick before June 1, 1948.

Review of Act

2.1(1)On or before January 1, 2020, and every five years after that, a comprehensive review of the provisions of this Act shall be undertaken as determined by the Workplace Health, Safety and Compensation Commission.
2.1(2)Within two years after a review is undertaken, the Workplace Health, Safety and Compensation Commission shall submit a report on the review to the Minister of Post-Secondary Education, Training and Labour, including a statement of any changes that the Workplace Health, Safety and Compensation Commission recommends.

Regulations
3The Lieutenant-Governor in Council may make regulations prescribing the rate or rates at which monthly payment shall be made under section 1 to a workman referred to in that section or to his widow.
