Natural Products Act

Under sections 17 and 19 of the Natural Products Act, the Commission makes the following regulation:
Title
1This Regulation may be cited as the Forest Products Marketing Boards RegulationNatural Products Act.
Definitions
2The following definitions apply in this Regulation.
“Act” means the Natural Products Act.(Loi)
“annual district meeting” means an annual district meeting of owners or producers, as the case may be, held in accordance with the forest products marketing boards regulations.(assemblée annuelle de district)
“annual meeting” means an annual meeting of delegates or owners, as the case may be, held in accordance with the forest products marketing boards regulations.(assemblée annuelle)
“board” means a board established under the New Brunswick Forest Products Marketing Plan Regulation – Natural Products Act.(office)
“member” means a member of a board.(membre)
“forest products marketing boards regulations” means the following regulations made under the Act: (règlements concernant les offices de commercialisation des produits forestiers)
(a) New Brunswick Regulation 2005-106;
(b) New Brunswick Regulation 2005-140;
(c) New Brunswick Regulation 2005-142;
(d) New Brunswick Regulation 2005-144;
(e) New Brunswick Regulation 2005-146;
(f) New Brunswick Regulation 2005-148;
(g) New Brunswick Regulation 2006-87.
Application of regulation
3Despite the forest products marketing boards regulations,
(a) this Regulation, except for section 6, applies to a board from the commencement of this Regulation to the date of the meeting of the board that follows the third annual meeting after the commencement of this Regulation, both dates inclusive, and
(b) section 6 applies to a board from the commencement of this Regulation to the date of the first annual meeting of the board after the commencement of this Regulation, both dates inclusive.
Annual district meetings and annual meetings
4Despite the forest products marketing boards regulations, a board shall not call an annual district meeting or an annual meeting in 2020.
Term of office of members
5(1)Despite the forest products marketing boards regulations, if the term of office of a member would, if not for this regulation, expire at the meeting of the board that follows the annual meeting, the member shall remain in office until the meeting of the board that follows the first annual meeting after the commencement of this Regulation.
5(2)Despite the forest products marketing boards regulations and subject to subsection (3), the term of office of a member who is elected to replace a member referred to in subsection (1) is two years and commences at the meeting of the board that follows the first annual meeting after the commencement of this Regulation.
5(3)Subsection (2) does not apply to the South East New Brunswick Forest Products Marketing Board.
Auditor
6Despite the forest products marketing boards regulations, the auditor responsible for auditing a board’s books of account for the 2020-2021 business year shall be appointed by the board and approved by the Commission.
