Under section 118 of the Fish and Wildlife Act, the Lieutenant-Governor in Council makes the following Regulation:
Citation
1This Regulation may be cited as the Hunting and Fishing Guides Licence Regulation - Fish and Wildlife Act.
Definitions
2(1)In this Regulation, “Act” means the Fish and Wildlife Act.(Loi)
2(2)For the purposes of this Regulation and of the definition “guide” in section 1 of the Act, “appropriate examination” means the examination established by the Minister.(examen spécial)
Licence application
3An application for a guide I or guide II licence referred to in section 15 of the Act shall be made to the Minister on the form provided by the Minister.
Ineligible if convicted of certain offences
4A person is not eligible to hold a guide I or guide II licence if he or she has been convicted of
(a) an offence under paragraph 32(1)(a) or (c), or 33(1)(a) or (b), or subsection 50(1) of the Act, or
(b) one or more offences under any other provision of the Act or the regulations under the Act within the 12 month period immediately preceding the application.
Examination
5(1)An appropriate examination shall be administered by a conservation officer and the performance of the applicant shall be assessed by that conservation officer, and there is no appeal from the officer’s assessment.
5(2)A person who fails the appropriate examination may not retake the examination for the purpose of applying for a guide I or guide II licence until the expiration of 30 days after the date of failing.
5(3)A person to whom a guide II licence had been issued before January 1, 2002, who no longer holds that licence, may apply for a guide II licence on the basis of having passed the appropriate examination before that date.
Expiry and renewal
6 A guide I or guide II licence expires on December 31 of each year and may be renewed by making an application to the Minister on the form provided by the Minister.
Information to be provided
7(1)The holder of a guide I or guide II licence shall provide any information and parts or portions of wildlife requested by the Minister at the time and place designated by the Minister.
7(2)A guide I or guide II licence shall have on its face the identification information for the licence holder required by the Minister.
Fees
8(1)The fee for a guide I licence or the renewal of a guide I licence is $25.
8(2)The fee for a guide II licence or the renewal of a guide II licence is $7.50.
8(3)The fee for replacing a licence issued or renewed under this Regulation is $5.25.
Commencement
9This Regulation comes into force on January 1, 2012.
