Under sections 14.1 and 190.072 of the Municipalities Act, on the recommendation of the Minister, the Lieutenant-Governor in Council makes the following Regulation:

INTERPRETATION
Citation
1This Regulation may be cited as the Rural Community of Saint-André Regulation - Municipalities Act.
Definition of “Act”
2In this Regulation, “Act” means the Municipalities Act.

INCORPORATION
Incorporation of Saint-André
3The village called Village de St. André is dissolved and the area comprising the local service district of the parish of Saint-André and the former Village de St. André is incorporated as a rural community and the name of the rural community is Saint-André.
Territorial limits of Saint-André
4The territorial limits of Saint-André are as follows:
Beginning at the point where the parish line between Saint-André Parish and Saint-Léonard Parish meets the international boundary line between the State of Maine and the Province of New Brunswick; thence in a southeasterly direction along the said international boundary line to a point where the said international boundary line meets the county line between Madawaska County and Victoria County; thence in a southeasterly direction along the said county line to a point on the southern prolongation of the eastern boundary of the lot with NB PID #35106459, the said point being also a point on the northern boundary of the town of Grand Falls; thence in a northerly direction along the said prolongation to a point on the southern right-of-way of the Canadian National Railway; thence in a southeasterly and northeasterly direction along the said right-of-way to the western corner of the lot with NB PID #65196206, the said corner being also a point on the county line between Madawaska County and Victoria County; thence in a northeasterly and northerly direction along the said county line to a point on the parish line between Saint-André Parish and Saint- Léonard Parish; thence in a southwesterly direction along the said parish line to the place of beginning.

5The inhabitants of the area referred to in section 4 are a body corporate called Saint-André.
Effective date of incorporation
6The effective date of the incorporation of Saint-André is July 31, 2006.

FORMER VILLAGE DE ST. ANDRÉ
Assets and liabilities of Village de St. André
7As of July 31, 2006, the assets and liabilities of the former village called Village de St. André are assets and liabilities of the rural community of Saint-André, and Saint-André for all purposes stands in the place and stead of the former village called Village de St. André.
By-laws of Village de St. André
8The dissolution of the former village called Village de St. André does not affect the by-laws in force in the former village, and the by-laws continue to apply to that portion of the rural community of Saint-André that comprised the former village called Village de St. André until repealed by the rural community council of the rural community of Saint-André.
Services in Village de St. André
9(1)Subject to subsection (2), the dissolution of the former village called Village de St. André does not affect the delivery of the following services which were provided in the former village, and the rural community of Saint-André shall continue to provide these services in that portion of the rural community of Saint-André that comprised the former village called Village de St. André:
(a) drainage;
(b) fire protection;
(c) garbage and refuse collection and disposal;
(d) sewerage;
(e) sidewalks;
(f) roads and streets;
(g) regulation of traffic;
(h) street lighting;
(i) water;
(j) parks;
(k) community services;
(l) tourist promotion and development;
(m) industrial development and promotion;
(n) urban redevelopment and urban renewal;
(o) housing;
(p) recreational and sports facilities;
(q) recreational and sports programs;
(r) first aid;
(s) police protection; and
(t) emergency measures.
9(2)The rural community of Saint-André may discontinue the provision of a service referred to in subsection (1) in accordance with section 28 of the Rural Community Administration Regulation - Municipalities Act.

FIRST ELECTION AND COUNCIL COMPOSITION
First election
10(1)For the purpose of the first election in Saint-André
(a) the notice of election shall be published no later than May 29, 2006,
(b) the nomination of candidates shall close at noon on June 9, 2006,
(c) the election shall be held on June 26, 2006, and
(d) the taking of the oath of office and the first meeting of the rural community council shall be held on July 10, 2006.
10(2)Notwithstanding paragraph (1)(d), if a quorum of the rural community council cannot be constituted on July 10, 2006, as a result of a petition requesting a recount under section 42 of the Municipal Elections Act, the taking of the oath of office and the first meeting of the rural community council shall be held within 10 days after the candidates have been declared elected under the Municipal Elections Act.
Council composition
11The rural community council of Saint-André shall be composed of the following members:
(a) the rural community mayor;
(b) one rural community councillor elected from each ward described in section 13; and
(c) one rural community councillor elected at large.
Remuneration of council
12The remuneration of the members of the first rural community council of Saint-André for the period falling between the date the members take the oath of office and July 31, 2006, shall be as follows:
(a) the rural community mayor shall receive $150.00; and
(b) each rural community councillor shall receive $75.00.
Wards
13There shall be 5 wards within the territorial limits described in section 4, consisting of the following:
(a) Ward 1, described as follows:

MISCELLANEOUS
Regulations under the Community Planning Act
16(1)On the incorporation of Saint-André, the following regulations under the Community Planning Act apply to that portion of the rural community that comprised the former local service district of the parish of Saint-André until they are repealed:
(a) the Saint-André Local Service District Basic Planning Statement Adoption Regulation; and
(b) the Saint-André Local Service District Zoning Regulation.
16(2)Repealed: 2021-7
16(3)On the incorporation of Saint-André, the Provincial Subdivision Regulation - Community Planning Act applies to that portion of the rural community that comprised the former local service district of the parish of Saint-André until the rural community enacts a subdivision by-law under section 74 of the Community Planning Act that is applicable to that portion of the rural community.

Borrowing authority
17Notwithstanding any provision of the Act or the Municipal Capital Borrowing Act, on July 31, 2006, any outstanding authority of the former village called Village de St. André to borrow money, granted and approved under the Municipal Capital Borrowing Act shall continue in the name of the rural community of Saint-André.
Unconditional grant
18Notwithstanding any provision of the Act or the Municipal Assistance Act, after July 31, 2006, the Minister shall pay or credit, as the case may be, to the rural community of Saint-André all amounts under the Municipal Assistance Act that are owed to or owed to the credit of the following:
(a) the former village called Village de St. André; and
(b) the former local service district of the parish of Saint-André.
