Under sections 10, 17 and 21 of the Apprenticeship and Occupational Certification Act, the Minister makes the following Regulation:

13.1(1)Notwithstanding the Minimum Wage for Categories of Employees in Crown Construction Work Regulation - Employment Standards Act, unless otherwise established as part of a collective agreement, the rate of wages for an apprentice whether for regular daily hours of work or for hours in excess of regular daily hours of work shall not be less than
(a) if the requirement is 1,800 hours of on-the-job training and work experience for the designated occupation,
(i) 50% during the first 900 hours, and
(ii) 65% during the second 900 hours;
(b) if the requirement is 3,600 hours of on-the-job training and work experience for the designated occupation,
(i) 50% during the first 900 hours,
(ii) 60% during the second 900 hours,
(iii) 70% during the third 900 hours, and
(iv) 80% during the fourth 900 hours;
(c) if the requirement is 5,400 hours of on-the-job training and work experience for the designated occupation,
(i) 50% during the first 900 hours,
(ii) 55% during the second 900 hours,
(iii) 60% during the third 900 hours,
(iv) 65% during the fourth 900 hours,
(v) 70% during the fifth 900 hours, and
(vi) 85% during the sixth 900 hours;
(d) if the requirement is 7,200 hours of on-the-job training and work experience for the designated occupation,
(i) 50% during the first 900 hours,
(ii) 55% during the second 900 hours,
(iii) 60% during the third 900 hours,
(iv) 65% during the fourth 900 hours,
(v) 70% during the fifth 900 hours,
(vi) 75% during the sixth 900 hours,
(vii) 80% during the seventh 900 hours, and
(viii) 85% during the eighth 900 hours; and
(e) if the requirement is 9,000 hours of on-the-job training and work experience for the designated occupation,
(i) 50% during the first 900 hours,
(ii) 55% during the second 900 hours,
(iii) 60% during the third 900 hours,
(iv) 65% during the fourth 900 hours,
(v) 70% during the fifth 900 hours,
(vi) 75% during the sixth 900 hours,
(vii) 80% during the seventh and eighth 900 hours, and
(viii) 85% during the ninth and tenth 900 hours;
of the average hourly rate of wages for journeypersons employed by the employer in the designated occupation or, where the employer is the only journeyperson employed, of the average hourly rate of wages for journeypersons in the area.
13.1(1.1)Despite subsection (1), an apprentice shall receive only one increase in his or her rate of wages in a six month period, regardless of the number of regular daily hours or hours in excess of regular daily hours he or she has worked during that period.
13.1(2)Notwithstanding subsection (1), in cases where provisions of the Minimum Wage Regulation - Employment Standards Act require the payment of a higher rate of wages than a rate established in subsection (1), the provisions of the Minimum Wage Regulation -Employment Standards Act shall apply.

Replacement diploma, certificate or letter
29The Board may provide a replacement diploma of apprenticeship, certificate of qualification or letter of authenticity to a person who submits to the Board an affidavit, on a form provided by the Director, and who proves to the satisfaction of the Board that the diploma, certificate or letter, as the case may be, has been lost or destroyed.
Form of joint application for work permit
30A joint application for a work permit under subsection 18(1) of the Act shall be on a form provided by the Director.
Form of work permit
31A permit to continue to work under subsection 18(1) of the Act shall be on a form provided by the Director.

4(1)The automotive service technician occupation includes
(a) the use of hand tools, shop equipment and service publications to diagnose, test, service, repair, replace, adjust and inspect the following systems and components on automobiles and light trucks:
(i) steering and suspension;
(ii) brakes;
(iii) power trains;
(iv) engines;
(v) fuel and exhaust;
(vi) electrical and electronic; and
(vii) accessories for systems and components listed in subparagraphs (i) to (vi); and
(b) the reclaiming, recovering, recycling and reusing of ozone depleting substances.
Qualifications for apprenticeship
4(2)No person shall be registered as an apprentice in the automotive service technician occupation unless the person
(a) has successfully passed Grade 12 or its equivalent as determined by the Board,
(b) is physically able to perform all of the duties of the automotive service technician occupation, and
(c) is willing to enter into an apprenticeship agreement in the automotive service technician occupation with an employer or a joint apprenticeship training committee.

4(2.1)In addition to any other requirements under a plan of apprenticeship, in order to obtain a diploma of apprenticeship an apprentice shall have acquired a total of 7,200 hours of on-the-job training and work experience.

Requirements of candidates for certificates of qualification
4(4)No person shall be a candidate for a certificate of qualification in the automotive service technician occupation unless the person
(a) completes and files with the Director the application provided by the Director,
(b) proves to the satisfaction of the Director that experience has been gained equivalent to 9,000 hours of practical experience in the automotive service technician occupation or that the person has successfully completed an apprenticeship program in that occupation under the Act, and
(c) pays the fee for the examination for the certificate of qualification.
Examinations
4(5)The examination for a certificate of qualification in the automotive service technician occupation shall be a written examination.
4(6)The mark required to successfully pass the examination is
(a) where the examination is conducted before January 1, 1998, sixty-five per cent, and
(b) where the examination is conducted on or after January 1, 1998, seventy per cent.

AUTOMOTIVE SERVICE TECHNICIAN (STEERING, SUSPENSION AND BRAKES) OCCUPATION
Scope of the occupation
6(1)The automotive service technician (steering, suspension and brakes) occupation includes
(a) the use of hand tools, shop equipment and service publications to diagnose, test, service, repair, replace, adjust and inspect steering, suspension and brake systems and components on automobiles and light trucks;
(b) the use of wheel alignment equipment to perform two and four wheel alignment on automobiles and light trucks; and
(c) the performing of inspections on automobiles and light trucks in accordance with the Motor Vehicle Act.
Qualifications for apprenticeship
6(2)No person shall be registered as an apprentice in the automotive service technician (steering, suspension and brakes) occupation unless the person
(a) has successfully passed Grade 12 or its equivalent as determined by the Board,
(b) is physically able to perform all of the duties of the automotive service technician (steering, suspension and brakes) occupation, and
(c) is willing to enter into an apprenticeship agreement in the automotive service technician (steering, suspension and brakes) occupation with an employer or a joint apprenticeship training committee.

BRICKLAYER OCCUPATION
Scope of the occupation
11(1)The bricklayer occupation includes
(a) the laying of bricks, concrete blocks, tiles and other building materials and the construction or repairing of walls, partitions, arches, fireplaces and other structures;
(b) the measuring of distances from reference points and the marking of guidelines on the working surface to lay the work;
(c) the laying of brick in horizontal rows or in designs or shapes and the spreading of mortar with a trowel to imbed them;
(d) the determining of vertical and horizontal alignment courses as the work progresses, using plumb line and level; and
(e) the fastening of brick or terra cotta veneer to the face of structures.
Qualifications for apprenticeship
11(2)No person shall be registered as an apprentice in the bricklayer occupation unless the person
(a) has successfully passed Grade 12 or its equivalent as determined by the Board,
(b) is physically able to perform all of the duties of the bricklayer occupation, and
(c) is willing to enter into an apprenticeship agreement in the bricklayer occupation with an employer or a joint apprenticeship training committee.

CONSTRUCTION ELECTRICIAN OCCUPATION
Scope of the occupation
17(1)The construction electrician occupation includes
(a) the installation and maintenance of electrical wiring systems and related equipment in residential, commercial and industrial establishments and other structures;
(b) the planning, execution and completion of wiring systems according to applicable codes, statutes, regulations, blueprints, specifications and other requirements of any governmental or other authority having jurisdiction;
(c) the installation, testing and energizing of load centres, panelboards, distribution boards, switchboards, sub-stations, switchgear, transformers and related protective devices required to ensure the integrity and safety of a wiring system;
(d) the installation and energizing of any wiring method acceptable under the code and regulations in force at the time of installation along with the terminating of the necessary conductors required to complete the wiring system of any establishment or structure;
(e) the installation, testing, energizing and maintenance of input and signal devices required to operate controllers or other operating devices involved with an automatic process system;
(f) the installation, testing, energizing and maintenance of motors, motor starters, motor controllers and motor protective devices;
(g) the installation, testing, energizing and maintenance of electrical emergency standby systems and interrelated control devices; and
(h) the installation, testing, energizing and maintenance of fire alarm systems, communication systems, intrusion alarm systems and other life safety and property protection systems.
Qualifications for apprenticeship
17(2)No person shall be registered as an apprentice in the construction electrician occupation unless the person
(a) has successfully passed Grade 12 or its equivalent as determined by the Board,
(b) is physically able to perform all of the duties of the construction electrician occupation, and
(c) is willing to enter into an apprenticeship agreement in the construction electrician occupation with an employer or a joint apprenticeship training committee.

(c) pays the fee for the examination for the certificate of qualification.

17(5)The examination for a certificate of qualification in the construction electrician occupation shall be a written examination.
17(6)The mark required to successfully pass the examination is
(a) where the examination is conducted before January 1, 1998, sixty-five per cent, and
(b) where the examination is conducted on or after January 1, 1998, seventy per cent.

OIL BURNER MECHANIC OCCUPATION

Scope of the occupation
44(1)The oil burner mechanic occupation includes:
(a) the installation, servicing and repairing, according to the applicable codes, of oil burners with firing rates up to and including four hundred thousand BTU’s or three gallons per hour, used for heating purposes;
(b) the installation, servicing and repairing, according to the applicable codes, of control devices and associated electrical wiring used in connection with the oil burner; and
(c) the installation, servicing and maintaining, according to the applicable codes, of associated equipment including oil tanks with a maximum capacity of 2500 litres (550 gallons).
Qualifications for apprenticeship
44(2)No person shall be registered as an apprentice in the oil burner mechanic occupation unless the person
(a) has successfully passed Grade 12 or its equivalent as determined by the Board,
(b) is physically able to perform all of the duties of the oil burner mechanic occupation, and
(c) is willing to enter into an apprenticeship agreement in the oil burner mechanic occupation with an employer or a joint apprenticeship training committee.

Requirements of candidates for certificates of qualification
44(4)No person shall be a candidate for a certificate of qualification in the oil burner mechanic occupation unless the person
(a) completes and files with the Director the application provided by the Director,
(b) proves to the satisfaction of the Director that experience has been gained equivalent to 7,200 hours of practical experience in the oil burner mechanic occupation or that the person has successfully completed an apprenticeship program in that occupation under the Act, and
(c) pays the fee for the examination for the certificate of qualification.
Examinations
44(5)The examination for a certificate of qualification in the oil burner mechanic occupation shall be a written examination.
44(6)The mark required to successfully pass the examination is
(a) where the examination is conducted before January 1, 1998, sixty-five per cent, and
(b) where the examination is conducted on or after January 1, 1998, seventy per cent.

PLUMBER OCCUPATION
Scope of the occupation
47(1)The plumber occupation includes the construction, extending, alteration, renewing or repairing of a plumbing system, together with all connections, fixtures and soil and vent piping as required in accordance with the Canadian Plumbing Code.
Qualifications for apprenticeship
47(2)No person shall be registered as an apprentice in the plumber occupation unless the person
(a) has successfully passed Grade 12 or its equivalent as determined by the Board,
(b) is physically able to perform all of the duties of the plumber occupation, and
(c) is willing to enter into an apprenticeship agreement in the plumber occupation with an employer or a joint apprenticeship training committee.

REFRIGERATION AND AIR CONDITIONING MECHANIC OCCUPATION
Scope of the occupation
52(1)The refrigeration and air conditioning mechanic occupation includes
(a) the installation, servicing and repairing of refrigeration equipment used in the home, business and industry for conditioning air and for the cooling of water, brine and all types of industrial products;
(b) the assembling and installation of compressors, condensers, evaporators, motors, other units of refrigeration equipment and refrigerant piping;
(c) the overhauling and repairing of pumps, compressors, valves, component parts and piping used in refrigeration and air conditioning systems; and
(d) the reclaiming, recovering, recycling or reusing of ozone depleting substances.

52(2)No person shall be registered as an apprentice in the refrigeration and air conditioning mechanic occupation unless the person
(a) has successfully passed Grade 12 or its equivalent as determined by the Board,

SPRINKLER SYSTEM INSTALLER OCCUPATION
Definitions
58(1)In this section
“fire protection” means the preventing and extinguishing of fires;(protection contre les incendies)
“low level maintenance” means
(a) the lubricating of control valve stems,
(b) the adjusting of packing glands on valves and pumps,
(c) the bleeding of moisture and condensation from air compressors, air lines and dry-pipe system auxiliary drains,
(d) the cleaning of strainers and clogged fire pump impellers,
(e) the replacing of
(i) loaded, corroded or painted sprinklers,
(ii) missing or loose pipe hangers,
(iii) valve seats and gaskets,
(iv) worn or missing fire hoses, and
(v) worn or missing nozzles,
(f) the restoration of heat to areas subject to freezing temperatures where water-filled piping is installed,
(g) the repairing of pipes due to failures caused by freezing, impact damage or broken underground fire mains, and
(h) the replacing of
(i) frozen or fused sprinklers,
(ii) defective electric power, and
(iii) alarm and detection system wiring. (faible niveau de maintenance)
Scope of the occupation
58(2)The sprinkler system installer occupation includes
(a) the assembling, installation, testing, repairing and maintenance of high pressure or low pressure pipeline systems for the supply of water, foam, gases, air or any other substance or material for the purpose of fire protection;
(b) the installation and repairing of outside services when these services are for fire protection use;
(c) the examining of drawings and specifications of sprinkler and fire protection systems or installations;
(d) the installation or repairing of fire protection and fire control systems, either by hand or power equipment, including all piping or tubing and appurtenances or equipment pertaining thereto, as well as standpipes and hose connections, when installed in connection with sprinkler systems, to sprinkler supply mains, sprinkler tank heaters, fire extinguishers, air lines and thermal systems used in connection with sprinkler alarm systems, except electrical alarm systems, and all tanks, pumps, and air compressors with respect thereto, and other fixed systems used for fire protection purposes;
(e) the connecting of equipment and fittings to piping systems related to sprinkler and fire protection installation; and
(f) the testing of sprinkler and fire protection systems for leaks with air or liquid pressure;
but does not include the performing of low level maintenance on sprinkler and fire protection systems.
