Under section 51 of the Occupational Health and Safety Act, the Lieutenant-Governor in Council makes the following Regulation:
Repealed: 2022-27
1This Regulation may be cited as the Code of Practice for Working with Material Containing Asbestos Regulation - Occupational Health and Safety Act.
2In this Regulation
“asbestos” means any of the following fibrous silicates:     
(a) chrysotile;
(b) amosite;
(c) crocidolite;
(d) actinolite;
(e) anthophyllite; or
(f) tremolite.
3An employer whose employees work with or disturb material containing asbestos at a place of employment shall adopt the code of practice entitled “A Code of Practice for Working with Materials Containing Asbestos in New Brunswick” as prepared by the New Brunswick Occupational Health and Safety Commission and dated March 19, 1992.
4An employer shall follow the code of practice specified in section 3 and shall ensure that employees follow the code of practice.
5An employee of an employer who has adopted the code of practice referred to in section 3 shall follow the code of practice.
