Under subsection 191(1) of the Municipalities Act, the Lieutenant-Governor in Council, upon the recommendation of the Minister, makes the following Regulation:

1This Regulation may be cited as the Terms and Conditions for Payment of User-Charges Regulation - Municipalities Act.
2If a person fails to pay a user-charge levied under section 193 or 193.1 of the Municipalities Act when it is due, the person shall pay a penalty on the user-charge of 1.125 per cent per month compounded monthly or 14.36 per cent per year.
3(1)If a person fails to pay the user-charge referred to in section 2 within forty-five days after the date it is due, the Minister may send the person a notice of such default by registered mail advising the person that if the user-charge and any penalties imposed on it are not paid within seven days after the receipt of the notice, the Minister may cause the service for which the user-charge is imposed to be disconnected.
3(2)Where the Minister sends the notice referred to in subsection (1) and the person to whom the notice is sent fails to pay the user-charge and penalties imposed on it within the required period, the Minister may cause the service to be disconnected.
3(3)Where a service has been disconnected under subsection (2), the service shall not be resumed until the user-charge, the penalties imposed on it and the cost of disconnection and re-connection have been paid.
3(4)The Minister may recover an amount due from a person in respect of a user-charge and the penalties imposed on it, together with the cost of disconnection of the service, in any competent court.
