REGULATION 86-121

Archives Act

Under section 13 of the Archives Act, the Lieutenant-Governor in Council makes the following Regulation:
1This Regulation may be cited as the General Regulation - Archives Act.
2In this Regulation
“Act” means the Archives Act.(Loi)
3The tariff of charges under the Act is as follows:
(a)for a request to inspect a public record referred to in subsection 10(3) of the Act, per request..............
$5.00;
 
(b)for a copy of a public record that is stored or recorded in printed form and can be copied on conventional photocopying equipment, per page..............
$0.20;
(c) for a copy of a public record that is stored or recorded in a manner other than that referred to in paragraph (b) or that cannot be reproduced on conventional photocopying equipment, the actual cost of reproduction.
4A request referred to in subsection 10.1(1) of the Act shall be submitted to the Provincial Archivist.
5An application under subsection 10.1(5) of the Act shall be submitted to the Committee by delivering it to a member of the Committee.
6(1)A referral under paragraph 10.3(1)(a) of the Act shall be in Form 1.
6(2)An applicant under paragraph 10.3(1)(a) of the Act shall complete Part A of Form 1 and shall deliver the entire Form 1 to a judge of The Court of King’s Bench of New Brunswick or to a clerk of The Court of King’s Bench of New Brunswick.
6(3)Where a judge of The Court of King’s Bench has completed Part B of Form 1, the applicant shall within fourteen days serve a copy of the completed Form 1 on the Chairman of the Committee.

7(1)A referral under paragraph 10.3(1)(b) of the Act shall be in Form 2.
7(2)An applicant under paragraph 10.3(1)(b) of the Act shall complete Form 2 and shall deliver it to the Ombud.
7(3)The applicant shall serve a copy of Form 2 as delivered to the Ombud on the Chairman of the Public Records Committee, and the referral shall be deemed to have been made when the Chairman has been served.

8(1)An appeal under subsection 10.7(1) of the Act shall be in Form 3.
8(2)An applicant under subsection 10.7(1) of the Act shall complete Part A of Form 3 and shall deliver the entire Form 3 to a judge of The Court of King’s Bench of New Brunswick or to a clerk of The Court of King’s Bench of New Brunswick.
8(3)Where a judge of The Court of King’s Bench has completed Part B of Form 3, the applicant shall within fourteen days serve a copy of the completed Form 3 on the Chairman of the Committee.

9Service under subsections 6(3), 7(3) and 8(3) shall be made in accordance with the Rules of Court.
10A referral or an appeal to a judge of The Court of King’s Bench shall be heard, with the necessary modifications, in accordance with the Rules of Court relating to applications.

11An undertaking under subsection 10.9(3) of the Act shall be in Form 4.
12This Regulation comes into force on September 1, 1986.
