Under section 135 of the Companies Act, the Lieutenant-Governor in Council makes the following Regulation:
1This Regulation may be cited as the Incorporation Fees Regulation - Companies Act.
INCORPORATION OF COMPANIES
FOR CHARITABLE, ETC., PURPOSES
2On an application for incorporation of a company subject to section 16 or 18 of the Companies Act or for incorporation of a company incorporated under Part II of the Companies Act, the fee is, where the capital stock or, where there is no capital stock, the cost value of the real and personal property,
(a)does not exceed $25,000..............

3(1)Subject to subsections (2), (3) and (4), on an application for supplementary letters patent, the fee is one hundred dollars.
3(2)On an application for supplementary letters patent increasing the capital stock or if there is no capital stock, increasing the cost value of the real and personal property, the fee is an amount determined by calculating the increased amount of
(a) the cost value of the real and personal property, or
(b) the capital stock
for which supplementary letters patent is applied and by fixing the fee prescribed by section 2 for that amount.
3(3)On an application for supplementary letters patent changing the name of the company, the fee is fifty dollars.
3(4)Where a company is directed to apply for supplementary letters patent in order to comply with the Income Tax Act (Canada) or the New Brunswick Income Tax Act, there is no fee.

4The fee for letters patent of continuation of a company is one hundred dollars.
4.1To consider the suitability of a name upon processing an application referred to in section 2 or subsection 3(3) or upon processing letters patent of continuation referred to in section 4, a fee of forty dollars shall be paid for the search of the name in addition to the fee prescribed in section 2, subsection 3(3) or section 4 but, where more than one search is made with respect to the same application or the same letters patent of continuation, the maximum additional fee is sixty dollars.

EXEMPTIONS
5Canadian Legion companies incorporated in the Province are exempted from the payment of incorporation fees.
ROYAL GAZETTE PUBLICATION FEE
6In addition to the fees prescribed for applications for letters patent, the fee prescribed by regulation under the Official Notices Publication Act to cover the cost of publication of notice of the granting of letters patent or supplementary letters patent shall be sent with all applications for letters patent.
