Under section 11 of the Electrical Installation and Inspection Act, the Lieutenant-Governor in Council makes the following Regulation:

1This Regulation may be cited as the General Regulation- Electrical Installation and Inspection Act.
2In this Regulation
“Act” means the Electrical Installation and Inspection Act;(loi)
“agent” includes an electrical contractor, electrician, sign installer contractor, sign installer and industrial instrument mechanic;(représentant)
“apprentice” means an apprentice in the construction electrician occupation or in the industrial electrician occupation under the Apprenticeship and Occupational Certification Act;(apprenti)
“attempt to dispose of” means offer for sale, display, advertise, promote or make any other attempt to convey;(tenter d’aliéner)
“circuit” means the path, usually metal, through which electric current can flow for a definite purpose;(circuit)
“Code” means the CSA Standard C22.1-21, Canadian Electrical Code, Part I, (25th Edition), Safety Standard for Electrical Installations, including all errata, with the exception of Rule 6-302(1)(c) and with the following modifications:
(a) Rule 6-104 is replaced by the following:
6-104 The number of consumer’s services of the same voltage and characteristic, terminating at any one supply service, run to, on, or in any building, shall not exceed six, unless there is a deviation allowed in accordance with Rule 2-030;
(b) Rule 6-206(1)(c) is replaced by the following:
6-206(1)(c) Subject to subrule (3), placed within the building being served as close as practicable to the point where the consumer’s service conductors enter the building, but in no case shall this distance exceed 5 m and may not be located in:
(i)coal bins, clothes closets, bathrooms and stairways;
(ii)rooms where the ambient temperatures exceed 30 oC under normal conditions;
(iii)dangerous or hazardous conditions;
(iv)locations where the headroom clearance is less than 2 m; or
(v)any similar location.
(b.1) Repealed:  2019-27
(b.2) Rule 26.724(e) is replaced by the following:
26-724(e) The receptacles specified in
(i)Item (d) shall not be located on the area of a counter directly in front of a kitchen sink or on the area of a wall, a permanently fixed island or a peninsular counter directly behind a kitchen sink, and
(ii)Items (d)(iv) and (v) may be located on the side of a permanently fixed island or a peninsular counter if the receptacle is no more than 300 mm below the counter and the counter extends no more than 150 mm beyond its support base or on or above the counter of the permanently fixed island or peninsular counter.
(c) the following Rule 34-106(3) is added:
34-106(3) Portable outdoor signs shall be provided with a factory-installed ground fault circuit interrupter which is integral to the attachment plug or a portable ground fault circuit interrupter installed within 600 mm of the attachment plug;
(d) Rule 76-004 is replaced by the following:
76-004 The grounding requirements for temporary services shall be in accordance with section 10 of the Code, with the exception of the ground electrode, which may consist of a single 3 m ground rod;
“dispose of” means sell, lease, rent, lend, give away or transfer title, ownership or possession;(aliéner)
“electrical contractor” means any person, firm, corporation, company or partnership holding a valid Electrical Contractors Licence Group 3 issued or renewed under this Regulation or a valid Electrical Contractors Licence Group 2 renewed under this Regulation;(entrepreneur en électricité)
“electrician-in-charge” means a licensed electrician authorized by his licence to direct the construction or maintenance of an electrical installation at the site and supervise other electricians employed in such construction or maintenance;(maître-électricien)
“emergency repair” means the repair or replacement of electrical equipment or conductors located between the supply connection and the line side of the service entrance main overcurrent device and includes the repair or replacement of(réparation urgente)
(a) a meter base lug,
(b) a meter base,
(b.1) a meter-mounting device,
(c) a ground conductor,
(d) a service head,
(e) a service mast, or
(f) a service conductor,
but does not include the repair or replacement of a main overcurrent device, a service disconnect or a panelboard;
“establishment” means any building where a permanently employed electrician is retained and includes all industrial buildings, warehouses and institutions;(établissement)
“improver” means any person selected for training in the construction electrician occupation or the industrial electrician occupation, either to improve that person’s capability in any area of the occupation or to prepare the person for qualification under the Apprenticeship and Occupational Certification Act;(stagiaire)
“industrial electrician” means any person holding a valid Industrial Electricians Licence issued or renewed under this Regulation;(électricien d’installations industrielles)
“industrial instrument mechanic” means a person holding a certificate of qualification in the industrial instrument mechanic occupation under the Apprenticeship and Occupational Certification Act;(mécanicien-réparateur d’instruments industriels)
“industrial instrumentation installation” means the installation, repair and replacement of instruments and control devices used to indicate, record and control operating variables associated specifically with instrumentation, process and control systems if the instruments and control devices have an open-circuit voltage not exceeding 150 volts to ground and an overcurrent protection rating not exceeding 15 amperes, and includes the initial installation and replacement of instrumentation signal and control cable but does not include the initial installation of associated branch circuits or raceways;(installation d’instruments industriels)
“owner” means a person who has the responsibility and control of a building or an electrical installation;(propriétaire)
“portable outdoor sign” means a sign designed not to be used in a fixed position that receives current through a flexible cord or cable, and which may be mounted on a trailer;(enseigne extérieure portative)
“professional electrical engineer” Repealed:  2019-27
“professional engineer” means an electrical engineer who is registered as a member under the Engineering and Geoscience Professions Act;(ingénieur)
“public building” means any building frequented by the public or in which the public would normally congregate for any purpose;(bâtiment public)
“qualified person” means a person familiar with the construction and operation of the apparatus and the hazards involved;(personne compétente)
“service entrance” means the raceway, conductors, splitter box, meter box or meter trough, service box, protective devices and grounding facilities and includes any other equipment associated with the delivery of electrical power from the point of connection of the public utility up to and including the main disconnect of the service;(entrée)
“service entrance relocation” means the removal and reinstallation of a meter base, consumer service raceway or conductors if the amperage rating or voltage rating of the service entrance is not changed, but does not include the removal and reinstallation of a service disconnect or panelboard;(réinstallation d’une entrée)
“sign” means an assembly consisting of electrical parts designed to attract attention by illumination, animation or other electrical means, singly or in combination, and includes(enseigne)
(a) outline lighting, and
(b) awning and canopy installations that are internally illuminated by means of a light source that is part of the installed assembly;
“sign installation work” means the installation, maintenance or repair of a sign, including the installation, maintenance or repair of an electrical connection to the load side of a sign service disconnect switch, but does not include the installation, maintenance or repair of a sign service disconnect switch;(travail d’installation d’enseigne)
“sign installer” mean a person holding a valid Sign Installers Licence issued or renewed under this Regulation;(installer d’enseigne)
“sign installer contractor” means a person, firm, corporation, company or partnership holding a valid Sign Installer Contractors Licence issued or renewed under this Regulation;(entrepreneur d’installateur d’enseigne)
“sign installer helper” means a person holding a valid Sign Installer Helpers Identification Card issued or renewed under this Regulation;(aide-installateur d’enseigne)
“sign service disconnect switch” means a lockable disconnecting means used to supply electric power to a sign;(sectionneur de branchement d’une enseigne)
“special inspection” means an inspection of an electrical installation where(inspection spéciale)
(a) the electrical inspection has been requested,
(b) a hazard has been indicated, or
(c) the electrical inspection is carried out under subsection 16(6.2);
“supply of power” means electrical power supplied from a supply authority’s system or approved generating plant;(alimentation)
“type I installation” means the installation and repair of branch circuits, devices, motors and appliances on existing type II installations, including domestic ranges, water heaters and clothes dryers, but no alteration or addition, except for the installation of a domestic range, water heater or clothes dryer, shall exceed ten outlets or a total of five kilowatts;(installation de type I)
“type II installation” means any electrical installation not exceeding two hundred amperes having a single phase supply of power less than three hundred volts between any two wires but possessing no features attributable to a type III installation;(installation de type II)
“type III installation” means any electrical installation having one or more of the following features:(installation de type III)
(a) requiring a three phase supply of power;
(b) requiring a supply voltage exceeding three hundred volts between any two wires;
(c) having a service entrance installation exceeding two hundred amperes in current capacity; or
(d) being an electrical installation of such specialized nature as to be subject to the rules of section 18, 20, 24, 34, 40, 44, 46, 52, 64 or 68 of the Code.

APPROVED EQUIPMENT
3(1)No person shall install, attempt to dispose of, dispose of or use any electrical equipment, electrical fixtures, appliances and their components which are not certified by the Canadian Standards Association, the Underwriters’ Laboratories of Canada or any other recognized testing laboratory acceptable to the Chief Electrical Inspector.
3(2)Notwithstanding subsection (1), the Chief Electrical Inspector may approve any equipment or apparatus of a specialized nature having a limited local market and for which regular certification and listing by the Canadian Standards Association appears to be impracticable.
3(3)Where any electrical equipment or apparatus is found to be faulty or does not meet the standards of the Code when installed in service, the Chief Electrical Inspector may prohibit the use of such electrical equipment or apparatus, notwithstanding approval by the Canadian Standards Association or any other recognized testing laboratory.
3(4)Buildings, structures, assemblies, equipment or components which are prewired and bear certification of the Canadian Standards Association or any other recognized certification organization acceptable to the Chief Electrical Inspector may be disposed of if the prewired electrical installation is included in the terms of certification.
3(5)Notwithstanding subsection (4) but subject to subsection (6), buildings, structures, assemblies, equipment and components may be prewired and disposed of if the electrical installation has been carried out by an electrical contractor who has obtained a wiring permit or a special wiring permit required by section 16.
3(6)No person shall prewire and dispose of more than one building a year in accordance with subsection (5).
3(7)Notwithstanding any other provision of this Regulation, the Chief Electrical Inspector may grant special permission for the reconnection and use of a building which is prewired but which does not meet the requirements for certification or for a wiring permit or a special wiring permit under section 16 if the Chief Electrical Inspector determines the building to be safe.

SERVICE ENTRANCES
4(1)Repealed: 98-54

4(3)Subject to subsection (4), an electrical installation shall include all the circuits normally supplied through the service box of a service entrance but in any building where two or more service boxes are connected to a common service entrance supply, there shall be as many electrical installations as the number of service boxes.
4(4)In any multiple occupancy building where the main service entrance subdivides to supply three or more occupancies, the main service entrance circuit shall be considered as being a type III installation, while each occupancy shall be considered separately as being a type II installation or a type III installation according to the features of each type of installation as defined in section 2.
4(5)Temporary electrical installations for construction purposes shall be considered as separate electrical installations and at no time shall such temporary electrical installations be interconnected with any of the circuits of the permanent electrical installation under construction, except where special approval has been granted by the Chief Electrical Inspector.
4(6)Temporary electrical installations for construction purposes shall not remain energized beyond six months, except where special approval has been granted by the Chief Electrical Inspector.

POWER TO INSPECT
5(1)The Chief Electrical Inspector may assign an inspector to inspect or re-inspect
(a) at any location whatsoever, any electrical installation made either before or after the coming into force of this Regulation, or
(b) at any place of business, any electrical appliance, fitting, cable, cord or other electrical equipment intended for use, disposition or sale at that place of business,
for the purpose of ensuring compliance with the requirements of the Act and this Regulation.
5(2)To facilitate an inspection or a re-inspection made under subsection (1), owners and their agents shall provide reasonable access to plant equipment and to business premises and shall make reasonable adjustments in operating or construction schedules as requested by an inspector at any time.

CERTIFICATE OF INSPECTION
6(1)The Chief Electrical Inspector may issue a certificate of inspection to the electrical contractor, sign installer contractor or owner of an electrical installation which has been inspected by an inspector and complies with the requirements of the Act and this Regulation.
6(2)If an electrical installation does not comply with the requirements of the Act and this Regulation and an inspector issues an order under subsection 5(3) of the Act, the order may be delivered personally or sent by registered mail
(a) to the owner or the electrical contractor or to both of them, or
(b) to the owner or the sign installer contractor or to both of them.
6(3)When the order is sent by registered mail under subsection (2), it shall be deemed to have been received on the fifth day after the day of mailing.
6(4)Notwithstanding the issuance of a certificate of inspection under subsection (1), an inspector may re-inspect an electrical installation and if the electrical installation does not comply with the requirements of the Act and this Regulation at the time of the re-inspection, he may recommend that the Chief Electrical Inspector cancel the certificate of inspection.

SPECIAL APPROVAL
7(1)The Chief Electrical Inspector may grant special approval of an electrical installation if
(a) the electrical installation existed before February 13, 1968,
(b) the electrical installation is required for temporary purposes, or
(c) the electrical installation is deemed safe by an inspector.
7(2)A special approval shall be given in writing by the Chief Electrical Inspector to the owner with the special conditions stated therein and the owner shall countersign the special approval agreeing to comply with the special conditions at all times.
7(3)A special approval shall be deemed withdrawn if an order is issued under subsection 5(3) of the Act.

HAZARDOUS INSTALLATIONS
8(1)Where an electrical installation is found to be of such a hazardous nature as to endanger persons or property and it is considered necessary to have the electrical installation removed from service, the inspector shall issue an order ordering the supply of power to the electrical installation to be disconnected.
8(2)Where the inspector issues an order under subsection (1), he shall serve notice of the order on the supply authority and the owner, stating the reason or reasons for removing the electrical installation from service.
8(3)Service of the notice under subsection (2) may be effected by
(a) delivering a copy of the notice to the supply authority and the owner, or
(b) forwarding copies of the notice by registered mail to the local office of the supply authority and to the owner.
8(4)Upon receipt of the notice served pursuant to subsection (2), a supply authority shall disconnect the supply of power to the hazardous electrical installation within a reasonable time and shall not connect or reconnect the supply of power until notified by the Chief Electrical Inspector that the electrical installation has been approved for service.
8(5)An owner, electrical contractor or sign installer contractor may apply for a special inspection of an electrical installation ordered out of service if he or she
(a) has made the changes necessary to eliminate the hazard from the electrical installation, and
(b) pays the prescribed charge for the special inspection.
8(6)An inspector, after carrying out the special inspection referred to in subsection (5), shall report to the Chief Electrical Inspector who may
(a) order the electrical installation to remain out of service by notice to the applicant, or
(b) order the electrical installation returned to service by notice to the supply authority and the owner.
8(7)Where in the opinion of the inspector any part of an electrical installation is unsafe, he shall notify the owner in writing of the unsafe condition and may have the supply of power disconnected from the hazardous portion of the electrical installation and may seal the circuit to prevent the supply of power being reconnected until the hazardous condition has been eliminated.
8(8)Where a seal has been applied under subsection (7), it shall not be broken or removed except by an inspector.

LICENCES
9(1)The Chief Electrical Inspector may issue the following licences:
(a) an Electrical Contractors Licence Group 3;
(b) an Electricians Licence Class 3;
(c) an Industrial Electricians Licence;
(d) a Sign Installer Contractors Licence; and
(e) a Sign Installers Licence.
9(2)The Chief Electrial Inspector may renew:
(a) any licence issued under paragraph (1)(a) to (e);
(b) an Electrical Contractors Licence Group 2 issued prior to January 1, 1968; and
(c) an Electricians Licence Class 2 issued prior to January 1, 1968.

ELECTRICAL CONTRACTORS AND SIGN INSTALLER CONTRACTORS LICENCES

10(1)No person shall undertake to carry out
(a) a type III installation unless he is the holder of a valid Electrical Contractors Licence Group 3 issued or renewed under this Regulation, or
(b) a type II installation or a type I installation unless he is the holder of a valid Electrical Contractors Licence Group 3 issued or renewed under this Regulation or a valid Electrical Contractors Licence Group 2 renewed under this Regulation.
10(1.1)Notwithstanding subsection (1), a person may undertake to carry out sign installation work if he or she is the holder of a valid Sign Installer Contractors Licence issued or renewed under this Regulation.
10(2)An Electrical Contractors Licence Group 3 may be issued to:
(a) a person who holds a valid Electricians Licence Class 3 issued or renewed under this Regulation and has at least two years’ experience in the construction electrician occupation since obtaining a diploma of apprenticeship or a certificate of qualification in the construction electrician occupation under the Apprenticeship and Occupational Certification Act; or
(b) a person, firm, corporation, company or partnership if such person, firm, corporation, company or partnership employs a person who
(i) holds a valid Electricians Licence Class 3 issued or renewed under this Regulation,
(ii) has had at least two years’ experience in the construction electrician occupation since obtaining a diploma of apprenticeship or a certificate of qualification in the construction electrician occupation under the Apprenticeship and Occupational Certification Act, and
(iii) certifies in writing that he is an employee of the person, firm, corporation, company or partnership.
10(3)A Sign Installer Contractors Licence may be issued to:
(a) a person who holds a valid Sign Installers Licence issued or renewed under this Regulation; or
(b) a person, firm, corporation, company or partnership if the person, firm, corporation, company or partnership employs a person who
(i) holds a valid Sign Installers Licence issued or renewed under this Regulation, and
(ii) certifies in writing that he or she is an employee of the person, firm, corporation, company or partnership.

ELECTRICIANS AND SIGN INSTALLERS LICENCES AND INDUSTRIAL INSTRUMENTATION INSTALLATIONS

11(1)No person shall make, repair or maintain an electrical installation unless he is authorized by
(a) a valid Electricians Licence Class 3 issued or renewed under this Regulation,
(b) a valid Electricians Licence Class 2 renewed under this Regulation, or
(c) a valid Industrial Electricians Licence issued or renewed under this Regulation.
11(1.1)Notwithstanding subsection (1), a person may
(a) perform sign installation work if he or she is the holder of a valid Sign Installers Licence issued or renewed under this Regulation, or
(b) work as a helper on sign installation work if he or she is the holder of a valid Sign Installer Helpers Identification Card issued or renewed under this Regulation and he or she works under the direct supervision of a holder of a valid Electricians Licence issued or renewed under this Regulation or a valid Sign Installers Licence issued or renewed under this Regulation.
11(1.2)Notwithstanding subsection (1), a person may
(a) perform an industrial instrumentation installation to an establishment if the person is an industrial instrument mechanic who is permanently employed in the establishment, or
(b) work as a helper on an industrial instrumentation installation to an establishment if the person works under the direct supervision of an industrial instrument mechanic who is permanently employed in the establishment and if the person is registered with the Apprenticeship and Occupational Certification Branch of the Department of Post-Secondary Education, Training and Labour and is
(i) the holder of a diploma of apprenticeship in the industrial instrument mechanic occupation under the Apprenticeship and Occupational Certification Act, or
(ii) the holder of a valid certificate of qualification in the industrial instrument mechanic occupation issued by another province in Canada.
11(2)No person, firm, corporation, company or partnership shall employ any person to make, repair or maintain an electrical installation unless that person is authorized by
(a) a valid Electricians Licence Class 3 issued or renewed under this Regulation,
(b) a valid Electricians Licence Class 2 renewed under this Regulation, or
(c) a valid Industrial Electricians Licence issued or renewed under this Regulation.
11(2.1)Notwithstanding subsection (2), a person, firm, corporation, company or partnership may employ a person to perform sign installation work if he or she is the holder of a valid Sign Installers Licence issued or renewed under this Regulation.
11(2.2)Notwithstanding subsection (2), an owner of an establishment may permanently employ an industrial instrument mechanic to perform industrial instrumentation installations.
11(3)Notwithstanding subsections (1) and (2),
(a) an apprentice, holder of a work permit issued under section 48 of the Apprenticeship and Occupational Certification Act, improver or a person holding a valid certificate of qualification in the construction electrician occupation issued by another province in Canada may make, repair or maintain an electrical installation if the person is registered with the Apprenticeship and Certification Branch of the Department of Post-Secondary Education, Training and Labour or holds an identification card issued by the Chief Electrical Inspector under subsection (6) and the person works as a helper under the direct supervision of the holder of a valid Electricians Licence Class 3 issued or renewed under this Regulation, and
(b) the holder of a valid Industrial Electricians Licence issued or renewed under this Regulation may make, repair or maintain electrical installations in public buildings and establishments where electricians are permanently employed.
11(4)An Electricians Licence Class 3 may be issued to
(a) the holder of a certificate of qualification in the construction electrician occupation under the Apprenticeship and Occupational Certification Act, or
(b) the holder of a diploma of apprenticeship in the construction electrician occupation under the Apprenticeship and Occupational Certification Act.
11(5)An Industrial Electricians Licence may be issued to
(a) the holder of a certificate of qualification in the industrial electrician occupation under the Apprenticeship and Occupational Certification Act, or
(b) the holder of a diploma of apprenticeship in the industrial electrician occupation under the Apprenticeship and Occupational Certification Act.
11(5.1)A Sign Installers Licence may be issued to a person who
(a) has completed, to the satisfaction of the Chief Electrical Inspector, a training course acceptable to the Chief Electrical Inspector,
(b) has at least two thousand documented hours of sign installation work experience, and
(c) has completed, to the satisfaction of the Chief Electrical Inspector, a competency test acceptable to the Chief Electrical Inspector.
11(6)The Chief Electrical Inspector may issue an identification card to any person holding a valid certificate of qualification in the construction electrician occupation issued by another province in Canada.
11(6.1)The Chief Electrical Inspector may
(a) issue a Sign Installer Helpers Identification Card to a person who is employed by an Electrical Contractor or a Sign Installer Contractor, and
(b) renew a Sign Installer Helpers Identification Card.
11(7)An identification card, including a Sign Installer Helpers Identification Card, shall be valid for a period of up to six months.
11(8)The holder of an identification card, including a Sign Installer Helpers Identification Card, shall be entitled to work only for the employer with whom the holder was employed at the time the identification card was issued.

12(1)All electrical construction shall be made under the direction of a licensed electrician qualified to act as the electrician in-charge of the construction pursuant to subsection (3) who shall
(a) remain on site or be readily available on site while the electrical construction is in progress, and
(b) supervise all other electricians employed on the electrical construction.
12(2)All electrical maintenance, alterations and extensions to establishments shall be made under the direction of a licensed electrician who shall
(a) remain on site or be readily available on site while the electrical work is in progress, and
(b) supervise all other qualified persons employed on the electrical work involved.
12(2.1)Where an industrial instrument mechanic performs an industrial instrumentation installation to an establishment, a licensed electrician shall remain on site or be readily available on site while the industrial instrumentation installation is in progress but shall not supervise the industrial instrument mechanic.
12(3)A person shall be qualified to act as the electrician-in-charge of the construction of
(a) a type III installation if he is the holder of a valid Electricians Licence Class 3 issued or renewed under this Regulation, or
(b) a type II installation or a type I installation if he is the holder of a valid Electricians Licence Class 3 issued or renewed under this Regulation or a valid Electricians Licence Class 2 renewed under this Regulation.

EXPIRATION AND RENEWAL OF LICENCES
13(1)Every licence expires one year from the date of issue or renewal.
13(2)Every person applying for a licence or the renewal of a licence shall complete an application form supplied for the purpose and shall forward the application form together with the prescribed charge for the licence to the Chief Electrical Inspector.
SUSPENSION AND REVOCATION OF LICENCES
14The Chief Electrical Inspector may suspend or revoke any licence issued or renewed under this Regulation if there is evidence of:
(a) repeated infractions of this Regulation;
(b) inadequate supervision at the construction site;
(c) incompetence and negligence by the licensee in the performance of his duties;
(d) the licensee having performed or engaged in an electrical installation which is not authorized by his licence;
(e) the licensee having obtained his licence through misrepresentation or fraud;
(f) the licensee’s failure to pay a prescribed charge;
(g) the electrical contractor’s or the sign installer contractor’s failure to comply with an order for change of an unapproved electrical installation;
(h) the electrical contractor or the sign installer contractor having carried out an electrical installation without obtaining a wiring permit or a special wiring permit required by this Regulation; or
(i) the licensee employing a person to make, repair or maintain an electrical installation who is not authorized by
(i) a valid Electricians Licence Class 3 issued or renewed under this Regulation,
(ii) a valid Electricians Licence Class 2 renewed under this Regulation,
(iii) a valid Industrial Electricians Licence issued or renewed under this Regulation,
(iv) a valid Sign Installers Licence issued or renewed under this Regulation, or
(v) a valid identification card, including a Sign Installer Helpers Identification Card, issued or renewed under this Regulation.

PRODUCTION OF LICENCE OR IDENTIFICATION CARD
15Any person holding a licence or identification card required by this Regulation, including a Sign Installer Helpers Identification Card, shall produce the licence or identification card upon the demand of an inspector.

WIRING PERMITS AND SPECIAL WIRING PERMITS
16(1)The Chief Electrical Inspector may only issue a wiring permit or a special wiring permit to the holder of
(a) a valid Electrical Contractors Licence Group 3 issued or renewed under this Regulation,
(b) a valid Electrical Contractors Licence Group 2 renewed under this Regulation, or
(c) a valid Sign Installer Contractors Licence issued or renewed under this Regulation.
16(1.1)The Chief Electrical Inspector may attach any terms or conditions to a wiring permit or special wiring permit that he or she considers necessary, and such terms and conditions shall be set out in the permit.
16(2)The Chief Electrical Inspector may defer issuing a wiring permit or a special wiring permit to any electrical contractor or sign installer contractor who has failed to comply with an order issued by an inspector under subsection 5(3) of the Act until the electrical contractor or sign installer contractor has complied with the order and has paid the prescribed charge for a special inspection.
16(3)Subject to subsection (5), no electrical contractor or sign installer contractor shall carry out an electrical installation until he or she has obtained a wiring permit or a special wiring permit.
16(4)A wiring permit or a special wiring permit shall not be transferable from one electrical contractor or sign installer contractor to another.
16(5)An electrical contractor may carry out a type I installation without obtaining a wiring permit or a special wiring permit if the work meets the requirements of the Code and this Regulation.
16(5.1)A sign installer contractor may undertake to carry out sign installation work without obtaining a wiring permit or a special wiring permit if he or she is repairing a sign that does not require any alterations to its bulkhead or its internal or external components, and the nature of the circuit is not altered.
16(5.2)When it is not possible for a wiring permit or a special wiring permit to be issued before an electrical contractor carries out an emergency repair, the electrical contractor may undertake to carry out the emergency repair without first obtaining the wiring permit or special wiring permit if the electrical contractor
(a) uses and duly completes an emergency repair tag in a form provided by the Chief Electrical Inspector, and
(b) obtains a special wiring permit on the first working day following the day on which the emergency repair is performed.
16(6)Subject to subsection (6.1), any electrical installation commenced prior to obtaining a wiring permit or a special wiring permit shall be subject to the charge for a special inspection in addition to the charge for the wiring permit or the special wiring permit.
16(6.1)An emergency repair is not subject to the charge for a special inspection if the electrical contractor has complied with subsection (5.2).
16(6.2)If a wiring permit or a special wiring permit includes a term or condition requiring the permit holder to notify the Chief Electrical Inspector when specified phases of construction have been reached and the permit holder fails to do so, an inspector may carry out an inspection.
16(7)A copy of the wiring permit or the special wiring permit and the identification sticker shall be posted by the electrical contractor or electrician-in-charge in a conspicuous place and shall not be removed until all inspections have been completed.
16(8)A sign installer or a sign installer contractor shall post a copy of the wiring permit or special wiring permit and the identification sticker in a conspicuous place on the sign service disconnect switch, and they shall not be removed until all inspections have been completed.
16(9)An electrical contractor or an electrician-in-charge shall post an emergency repair tag in a conspicuous place on the meter base, and the tag shall only be removed by the supply authority after it has reconnected the supply of power.
16(10)A supply authority shall deliver an emergency repair tag removed under subsection (9) to the Chief Electrical Inspector within seven days after it has been removed.

APPROVAL OF PLANS
17(1)Subject to subsection (2), on request, the Chief Electrical Inspector may approve the plans and specifications for a type III installation if they comply with the requirements of the Code and this Regulation.
17(2)No person, firm, corporation, company, partnership or electrical contractor shall attempt to install a type III installation with any of the following ratings without the approval of the Chief Electrical Inspector of one copy of a set of plans and specifications that have been stamped, signed and dated by a professional engineer and that comply with the requirements of the Code and this Regulation:
(a) greater than 600 amperes for a 120/240 volts single phase;
(b) greater than 400 amperes for a 120/208 volts three phase;
(c) greater than 400 amperes for a 347/600 volts three phase; or
(d) greater than 347/600 volts.
17(3)Despite subsections (1) and (2), the Chief Electrical Inspector may authorize wiring permits to be issued without the approval of the plans and specifications on all temporary services and on all prebuilt approved electrical systems installed in or on a moveable van, trailer, building or other structure.
17(4)No change shall be made to the set of plans and specifications referred to in subsection (1) or (2) without the approval of the Chief Electrical Inspector.
17(5)When work on a type III installation is in progress, the electrical contractor shall ensure that
(a) if the plans and specifications were approved by the Chief Electrical Inspector under subsection (1), a copy of the approved plans and specifications is available on site at all times,
(b) if the plans and specifications were approved by the Chief Electrical Inspector under subsection (2), a copy of the approved plans and specifications is available on site at all times, or
(c) in any other case, a copy of the plans and specifications is available on site at all times.

SUPPLY CONNECTIONS
18(1)No supply authority shall connect or reconnect the supply of power to any electrical installation unless a wiring permit or a special wiring permit has been issued under section 16 for that electrical installation.
18(2)When a supply authority makes a supply connection, the electrical installation shall meet the minimum requirements for a service entrance under section 4.
18(3)Notwithstanding subsection (1), a supply authority may, in its discretion, reconnect the supply of power to an electrical installation previously disconnected because of non-payment or because of a change of occupant if there has been no change in the service entrance during the time of disconnection, but a supply authority may, in such cases as it deems necessary for the protection of persons or property, demand that the owner have the electrical installation inspected and approved by an inspector before making the reconnection.
18(4)Notwithstanding subsection (1), a supply authority may reconnect the supply of power to an electrical installation if an emergency repair has been carried out and an emergency repair tag completed in accordance with paragraph 16(5.2)(a) is posted on the meter base.

DEMANDS TO INSPECT
19Any person may make a written demand on the Chief Electrical Inspector for a special inspection of any owner’s electrical installation stating the reasons for the demand and shall pay the prescribed charge for the special inspection.
PUBLIC BUILDINGS
20The owner of a new public building or a new addition to a public building shall not open the building or the addition to public use unless the electrical installation therein has been approved by an inspector.
PUBLIC BUILDINGS AND ESTABLISHMENTS

21The owners of public buildings and establishments whose operation requires frequent maintenance and alterations performed by their own permanently employed electricians shall be exempt from sections 10, 16, 17 and 18, if each electrician holds
(a) a valid Electricians Licence Class 3 issued or renewed under this Regulation,
(b) a valid Electricians Licence Class 2 renewed under this Regulation, or
(c) a valid Industrial Electricians Licence issued or renewed under this Regulation
and the work meets the requirements of the Code and this Regulation.

CARNIVAL AND EXHIBITION WIRING PERMITS
22(1)No person shall open to the public or operate a temporary carnival, exhibition, show or any other such presentation where a temporary electrical installation is required without obtaining a special wiring permit and no one shall connect the supply of power to such an electrical installation unless it has been inspected and approved by an inspector.
22(2)Application for a special wiring permit shall be made to the Chief Electrical Inspector at least ten days before the opening date of the carnival, exhibition, show or other such presentation.
22(3)The application for the special wiring permit shall state the location and opening date of the carnival, exhibition, show or other such presentation and shall be accompanied by the charge for a special wiring permit.
22(4)A special wiring permit shall be effective only for the location shown thereon.
CHARGES
23(0.1)In this section, “overtime” means time worked on a Saturday or holiday and any time worked after 5:00 p.m. of any day and before 8:00 a.m. of the following day.
23(1)The charges for electrical contractors licences are as follows:
(a) for the issuance or a renewal of an Electrical Contractors Licence Group 3 - $400; and
(b) for the renewal of an Electrical Contractors Licence Group 2 - $250.
23(2)The charges for electricians licences are as follows:
(a) for the issuance or a renewal of an Electricians Licence Class 3 - $50;
(b) for the renewal of an Electricians Licence Class 2 - $50; and
(c) for the issuance or a renewal of an Industrial Electricians Licence - $50.
23(2.1)The charge for the issuance or renewal of a Sign Installer Contractors Licence is $100.
23(2.2)The charges for sign installers licences are as follows:
(a) for the issuance of a Sign Installers Licence - $100; and
(b) for the renewal of a Sign Installers Licence - $50.
23(3)The charge for an identification card issued under subsection 11(6) is $50.
23(3.1)The charge for the issuance or renewal of a Sign Installer Helpers Identification Card is $50.
23(4)Repealed: 2003-64
23(5)Subject to subsection (6.1), the charge for a special inspection of an electrical installation is $100 per hour or any part of an hour, with a minimum charge of $100.
23(6)Subject to subsection (6.1), the charge for the approval of plans for a type III installation shall be according to the ampere and voltage rating of the installation at the following rates:
(a) 401 amperes or greater, 120/240 volts single phase, 201 to 400 amperes, 120/208 volts three phase, 101 to 200 amperes, 347/600 volts three phase - $100 per hour or any part of an hour, with a minimum charge of $100;
(b) 401 to 2000 amperes, 120/208 volts three phase, 201 to 1000 amperes, 347/600 volts three phase - $100 per hour or any part of an hour, with a minimum charge of $100; and
(c) all others - $100 per hour or any part of an hour, with a minimum charge of $100.
23(6.1)The fees under subsections (5) and (6) shall be $150 per hour or any part of an hour for inspections done during overtime, with a minimum charge of $150.
23(6.2)Despite subsections (6) and (6.1), the fee for the approval of the plans and specifications for a type III installation referred to in subsection 17(2) is $100.
23(7)The charges, per electrical installation, for special wiring permits for carnivals and exhibitions, shows or other such presentations are as follows:
(a) for 50 K.V.A. or less, 200 amperes or less, 120/240 volts single phase or 120/208 volts three phase - $200;
(b) for 72 amperes or less, 240 to 600 volts - $200;
(c) for 51 to 100 K.V.A., 201 to 400 amperes, 120/240 volts single phase or 120/208 volts three phase - $300;
(d) for 120 amperes or less, 240 to 600 volts - $300; and
(e) for all electrical installations over 100 K.V.A. and for all electrical installations that are in excess of the amperes and volts referred to in paragraphs (a) to (d) - $400.
23(7.1)The charge for a special wiring permit for an emergency repair or for meter detachment and reattachment for siding installation is $50.
23(8)The charges for wiring permits are as follows:
(a) for temporary installations for construction that are
(i) 200 amperes or less, 120/240 volts single phase or 120/208 volts three phase - $60;
(ii) 72 amperes or less, 347/600 volts three phase - $60;
(iii) 201 to 400 amperes, 120/240 volts single phase or 120/208 volts three phase - $125;
(iv) 73 to 200 amperes, 347/600 volts three phase - $125;
(v) 401 to 600 amperes, 120/240 volts single phase or 120/208 volts three phase - $175;
(vi) 201 to 400 amperes, 347/600 volts three phase - $175;
(vii) all others - $300;
(b) for all type II installations and type III installations up to and including the first 50 K.V.A. that do not require a new service connection - $115;
(c) for all type II installations and type III installations up to and including the first 50 K.V.A. that require a new service connection - $115;
(d) for type III installations in excess of 50 K.V.A., $1.65 per K.V.A for the first 1 000 K.V.A., then $1 per K.V.A. thereafter;
(e) notwithstanding paragraphs (b), (c) and (d), for service entrance relocations - $115;
(f) for sign installation work
(i) for a single sign at a location - $75, or
(ii) for two or more signs at a location - $75 for the first sign plus $10 for each additional sign.
23(9)A K.V.A. rating is derived from one of the following formulas:
(a) Single Phase K.V.A. =
Volts × Amperes;

(b) Three Phase K.V.A. =
1.73 × Volts × Amperes;

23(10)When an existing type III installation of four hundred amperes or more is increased in capacity to supply a greater connected load, installed or proposed, the true K.V.A. rating for the purpose of determining the charge under paragraphs (8)(b) and (c) shall be the total final capacity of the installation less the capacity of the installation before the start of construction under the wiring permit concerned.
23(11)The charge for wiring permits for multiple occupancy installations as defined in subsection 4(4) shall be according to the K.V.A. rating of the main service entrance plus fifty per cent of the applicable charge for each single occupancy type II installation or type III installation subdivision of the main service entrance, but where a change in the service entrance is not required, the charge for wiring permits for alterations and additions shall be in accordance with subsection (8).

QUALIFIED PERSONS
24Notwithstanding anything in this Regulation, a qualified person may make minor repairs to or replacements of electrical installations if he does not make any changes or modifications to the circuits and the work meets the requirements of the Code and this Regulation.
CONFLICTS
25Where a conflict exists between this Regulation and the Code, this Regulation shall govern.
FORMS
26The Chief Electrical Inspector may
(a) make such reports and forms deemed necessary for the proper administration of the Act and this Regulation, and
(b) modify any form made pursuant to paragraph (a).
REPEAL
27Regulation 68-13 under the Electrical Installation and Inspection Act is repealed.
