REGULATION 84-107
under the
Salvage Dealers Licensing Act

Under section 21 of the Salvage Dealers Licensing Act, the Lieutenant-Governor in Council makes the following Regulation:

1This Regulation may be cited as the General Regulation - Salvage Dealers Licensing Act.
2In this Regulation
“Act” means the Salvage Dealers Licensing Act.(loi)
3(1)A record of every purchase or receipt of salvage required to be kept under section 7 of the Act shall be on a form provided by the Minister.
3(2)A salvage dealer shall keep the record referred to in subsection (1) in a binder separate from any other records.
3(3)In addition to the information required under subsection 7(1) of the Act, the record referred to in subsection (1)
(a) shall indicate the licence number of the salvage dealer and the location of the salvage yard, and
(b) in the case of salvage referred to in subsection (5), shall further indicate the information that appears on a valid photo identification issued by the government of the Province or of another province or a territory of Canada to the person from whom the salvage was purchased or received.
3(3.1)In addition to the information required under subsection 7(1) of the Act and subsection (3), in the case of a catalytic converter, the record referred to in subsection (1) shall indicate the registration number of the vehicle from which it came.
3(4)All entries on the record referred to in subsection (1) shall be legibly written in English or French and shall be entered on the record at the time of purchase or receipt.
3(5)Without restricting the generality of subsection 7(1) of the Act, a salvage dealer shall keep the record referred to in subsection (1) for salvage of the following description:
(a) plumbers’ lead in bars;
(b) brass valves;
(c) copper flashing;
(d) lead flashing;
(e) copper wire; and
(f) catalytic converters.

4(1)A receipt required to be given by a salvage dealer under section 11 of the Act shall be on a form provided by the Minister.
4(2)The receipt referred to in subsection (1)
(a) shall sufficiently describe the salvage purchased or received so that it may be readily and easily identified,
(b) shall state
(i) the date of purchase,
(ii) the price paid,
(iii) the name and address of the person from whom the salvage was purchased or received,
(iv) in the case of salvage referred to in subsection 3(5), in addition to the information required under subparagraphs (i) to (iii), the information that appears on a valid photo identification issued by the government of the Province or of another province or a territory of Canada to the person from whom the salvage was purchased or received, and
(v) in the case of a catalytic converter, in addition to the information required under subparagraphs (i) to (iv), the registration number of the vehicle from which it came, and
(c) shall be signed by the person giving the receipt.

5An application for a licence shall be made to the Minister, accompanied by the prescribed fee, and shall include
(a) the name and address of the applicant,
(b) the nature of the business for which a licence is required,
(c) the address of the premises on which the business is to be carried on, and
(d) the exact location of every salvage yard owned or operated by the applicant.

6Notwithstanding any date expressly stated on a licence or a renewal thereof issued under the Act, a licence or a renewal thereof issued under the Act shall remain in effect until the thirtieth day of June in the second year from the date of issue.
7The fee for a licence or a renewal thereof issued under the Act is one hundred and fifty dollars.

8A licence shall be on a form provided by the Minister.

9Regulation 144, Statutory Orders and Regulations, 1963, under the Salvage Dealers Licensing Act is repealed.
