REGULATION 83-111
under the
Garnishee Act

Under section 33 of the Garnishee Act, the Lieutenant-Governor in Council makes the following Regulation:
Repealed: 2013, c.32, s.15
1This Regulation may be cited as the Fees Regulation - Garnishee Act.
2In this Regulation
“Act” means the Garnishee Act.(loi)
3(1)For the purposes of the Act, the fees for solicitor’s services allowable to a party entitled to costs shall be as follows:
(a) on application for a garnishee order, including granting of order or dismissal of application:
(i) to party having carriage of the application..............$100.00,
(ii) to each additional party..............$60.00;
(b) on application to set aside garnishee order, including granting of order or dismissal of application:
(i) to party having carriage of the application..............$75.00,
(ii) to each additional party..............$50.00;
(c) where in an application
(i) the issues are complex,
(ii) the issues are unusually important,
(iii) unusual difficulties are involved in its conduct, or
(iv) the amount involved exceeds five thousand dollars,
a judge may allow such additional fees to any party to the application as he considers fair and reasonable.
3(2)For the purposes of the Act, for each day’s attendance at trial and for travel, witness fees and travel allowance shall be the same as are allowed in actions in The Court of Queen’s Bench of New Brunswick.
3(3)For the purposes of the Act, sheriff’s fees shall be the same as are allowed for similar services in The Court of Queen’s Bench of New Brunswick.
3(4)For the purposes of the Act, on filing any paper or for other service, clerk’s fees shall be the same as are allowed for similar services in actions in The Court of Queen’s Bench of New Brunswick.
4Regulation 74-172 under the Garnishee Act is repealed.
