Under section 56 of the Financial Administration Act, the Lieutenant-Governor in Council makes the following Regulation:

Citation
1This Regulation may be cited as the Fees for the Provision of Environmental Information Regulation - Financial Administration Act.
Definitions
2In this Regulation
“parcel” means a parcel of land to which Service New Brunswick has assigned one parcel identifier.(parcelle)
Fees
3The Minister of Environment and Climate Change may charge the following fees under this Regulation:
(a) per parcel, for provision of the environmental information described in section 4, where the information is available to that Minister and it is practicable to provide it..............$55.00
(b) subject to paragraph (a), on request, for research about and preparation and explanation of environmental information described in section 4, or other information that may be contained in records maintained by that Minister respecting contamination of a parcel, including provision of information not described in section 4 and provision of a detailed explanation of any information that may be contained in records maintained by that Minister in relation to the parcel, per hour or portion of an hour spent by an employee of the Department of Environment and Local Government..............$30.00

Environmental information
4The environmental information referred to in section 3 respecting a parcel is as follows:
(a) a report stating whether or not the parcel is registered in the petroleum storage tank management system database or identified in associated files maintained by the Minister of Environment and Climate Change as having, or having had, a petroleum product storage tank located within its boundaries;
(b) if, as described in paragraph (a), a parcel is registered or identified as having, or having had, a petroleum product storage tank located within its boundaries,
(i) the size of the tank,
(ii) an indication as to whether the tank is or was above or below ground,
(iii) a description of the material used in the construction of the tank, and
(iv) the year in which the tank was installed and, if the tank has been removed, the year of removal;
(c) a report stating whether or not any order is registered in relation to the parcel in the compliance and enforcement information management system database maintained by the Minister of Environment and Climate Change;
(d) a report stating whether or not the parcel is registered in the polychlorinated biphenyl storage site database maintained by the Minister of Environment and Climate Change;
(e) a report stating whether or not the parcel is registered in the remediation site management system database maintained by the Minister of Environment and Climate Change; and
(f) a report stating whether or not the parcel is registered in the dump site database maintained by the Minister of Environment and Climate Change.

Commencement
5This Regulation comes into force on February 1, 2002.
N.B. This Regulation is consolidated to December 18, 2020.
