Under section 67 of the Registry Act, the Lieutenant-Governor in Council makes the following Regulation:
1This Regulation may be cited as the Fees Regulation - Registry Act.
2In this Regulation
“Act” means the Registry Act.
3(1)The following Schedule of Fees is prescribed for the purposes of the Act:
(a) subject to paragraphs (b) to (f) and subsection (3), for registering an instrument in which a parcel is referred to, including an instrument registered under the Construction Remedies Act or filed under the Employment Standards Act, and for endorsement of the certificate of the registrar
(i)for the first five parcels referred to in the instrument, per parcel..............$85
 
(ii)for the next forty-five parcels referred to in the instrument, per parcel..............$25
 
(iii)for all parcels referred to in the instrument in excess of those referred to in subparagraphs (i) and (ii), per parcel..............$10
(b) for registering an instrument that does not conform with the Instrument Standards Regulation - Registry Act, the cost of copying plus the greater of
(i) the fee that would be payable under paragraph (1)(a) for the registration if the fee were based on the number of parcels referred to in the entire instrument, and
(ii) a fee of ..............$175
(c) subject to paragraph (e), for filing a plan, including endorsement of the certificate of the registrar,
(i)for the first five parcels shown on the plan, per parcel..............$85
 
(ii)for the next forty-five parcels shown on the plan, per parcel.............. $25
 
(iii)for all parcels shown on the plan in excess of those referred to in subparagraphs (i) and (ii), per parcel..............$10
(d) for registering, under the Condominium Property Act, an instrument in which no reference to a unit is made, including an order under section 60 of that Act in which no reference to a unit is made, a declaration and description, an amendment to a declaration and description, a dedication of additional land, bylaws or rules..............$85
(e) for registering, under the Condominium Property Act, a plan of survey attached to an instrument registered under paragraph (d) or a plan of survey amending a previously filed instrument or plan of survey
(i)for the first five units shown on the plan, per unit..............$85
 
(ii)for the next forty-five units shown on the plan, per unit..............$25
 
(iii)for all units shown on the plan in excess of those referred to in subparagraphs (i) and (ii), per unit..............$10
(f) subject to paragraph (e), for registering, under the Condominium Property Act, an instrument in which reference to at least one unit is made, including an order under section 60 of that Act in which reference to at least one unit is made, an instrument that amends a previously filed instrument or plan of survey, a notice of termination, a notice of lien, a discharge of lien, a discharge of encumbrances or an order of termination
(i)for the first five units referred to in the instrument, per unit..............$85
 
(ii)for the next forty-five units referred to in the instrument, per unit..............$25
 
(iii)for all units referred to in the instrument in excess of those referred to in subparagraphs (i) and (ii), per unit..............$10
(g) for   registering   or   filing   any   instrument or   document    not    provided    for    under   paragraphs (a)  to (f) ..............$85
(h) for certification of a copy of any instrument registered or filed, the cost of copying plus ..............$13
(i) Repealed: 2008-88
(j) for access to and use of the real property registry, per individual per half day or less ..............$17.50
(k) for copies, per page .............. $0.50
3(2)For the purposes of this section, the registrar may determine when and how copies are to be produced.
3(3)The fee for registering an instrument that contains more than one discharge or assignment shall be the greater of
(a) the fee that would be payable under paragraph (1)(a) for the registration if the fee were based on the number of parcels referred to in the entire instrument, and
(b) the fee that would be payable under paragraph (1)(a) for the registration if each discharge or assignment were considered to be a separate instrument.
